CITY OF ROSEVILLE <br />PUBLIC IMPROVEMENT CONTRACT <br />ROSEDALE EXPANSION SITE <br />This AGREEMENT, dated , is entered into between the CITY OF <br />ROSEVILLE, a Minnesota municipal corporation, of 2660 Civic Center Drive, Roseville, <br />Minnesota 55113 ("CITY"), and PPF RTL ROSEDALE SHOPPING CENTER, LLC, a <br />Delaware limited liability company, by its agent Jones, Lang, LaSalle Properties, 1595 <br />Highway 36 West, with offices at 10 Rosedale Center, Roseville, MN 55113 <br />("DEVELOPER"). <br />1. Recitals. <br />A. On August 7, 2015, the DEVELOPER applied for a Planned Unit <br />Development amendment ("PUD Amendment") for the addition of an <br />approximately 141,000 square foot anchor expansion and five additional <br />outbuildings at the Rosedale Center shopping mall ("Rosedale Center"). <br />B. In connection with the application for a PUD Amendment, the DEVELOPER <br />hired a traffic consultant to conduct a study of traffic around Rosedale Center <br />and the impacts from the proposed PUD Amendment (the "Traffic Study"). <br />C. The Trafiic Study identified that traffic levels at the COUNTY ROAD B2/ <br />SOUTHBOUND TH 51 RAMP/ NORTHWEST MALL ENTRANCE <br />Intersection (the "INTERSECTION") were currently operating at <br />unacceptable levels. <br />D. Based on the Traffic Study, the CITY determined the following improvements <br />and modifications (the "Public Improvements"), as depicted in Exhibit B, are <br />necessary at the INTERSECTION, independent of the DEVELOPER's <br />application for the PUD Amendment, for the benefit of Rosedale Center: <br />1. Install a second westbound left turn lane; <br />2. All required improvements necessary to perpetuate the addition of <br />the second westbound left turn lane including, but not limited to: <br />a. Relocation of the eastbound right turn and through lanes; <br />b. Reconfiguration of existing northbound free right turn lane <br />into conventional signal controlled right turn lane; and <br />Page 1 of 9 <br />
