B. Submission: 1. Filing: Four (4) copies of the preliminary plat shall be filed with the Community Development Director prior to the regular Planning Commission meeting at which the plat is to be considered together with the filing fee and abstractor's certified property certificate, showing the property owners within three hundred fifty feet (350') of the outer boundary of the proposed subdivision. Any necessary applications for variance from the provisions of this or other applicable Code provisions shall be filed with the proper City official before a preliminary plat will be considered officially filed. XVII. Chapter 1102, Section 1102.01, subparagraph D is hereby amended to read as follows: 1102.01 : D. Hearing by Planning Commission: 1. Hearing on the preliminary plat: The Planning Commission shall hold a public hearing on the preliminary plat in accordance with the procedure set forth in Chapter 108. 2. Report of the Planning Commission: Within ten (10) days after the completion of the hearing, the Planning Commission shall make a report concerning the preliminary plat unless the Planning Commission requests additional time as set forth in Chapter108. XVIII. Chapter 1102, Section 1102.01 subparagraph E 1 is hereby amended to read as follows: E. Action by the City Council: 1. The recommendation of the Planning Commission on the preliminary plat shall be considered by the City Council, and the City Council shall approve or disapprove the plan within sixty (60) days after the application was accepted as complete or such date as extended by the applicant or City Council. If the City Council shall disapprove said preliminary plat, the grounds for any such refusal shall be set forth in the proceedings of the City Council and reported to the J:\char\wp\resoluti\1176.ord 8
