1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />8 <br />9 <br />10 <br />PUBLIC IMPROVEMENT CONTRACT <br />11 <br />CHERRYWOOD POINTE ATLEXINGTON <br />12 <br />13 <br />14 <br />Parties. <br />I. This Agreement, dated ____________, 2016, is entered into between the City of Roseville, <br />15 <br />a Minnesota municipal corporation, whose address is 2660 Civic Center Drive, Roseville, Minnesota <br />16 <br />City <br />55113 (“the ”), and Cherrywood Pointe of Roseville at Lexington LLC, a Minnesota limited <br />17 <br />Owner <br />liability company (the “”) whose address is 3600 American Boulevard W, Suite 750, <br />18 <br />Developer <br />Bloomington, MN 55431 (the “”). <br />19 <br />Request for Plat approval. <br />II. The Developer has asked the City to approve a plat of land to be known <br />20 <br />Cherrywood Pointe at Lexington <br />as “”(also referred to in this Agreement as the “Plat”). The land is <br />21 <br />legally described as follows: <br />22 <br />See Legal Description attached as Exhibit Ahereto (the “Property”). <br />23 <br />24 <br />Terms and Conditions of Plat Approval. <br />III. For good and valuable consideration, the receipt and <br />25 <br />sufficiency of which are hereby acknowledged, the parties agree as follows: <br />26 <br />Plat Approval: Subject to the terms and conditions of this Public Improvement Contract, the <br />A. <br />27 <br />recitals above, and all other applicable City Code provisions, the City hereby approves the <br />28 <br />recording of the Plat. <br />29 <br />Land Use: A senior housing facility will be built on the Property. <br />B. <br />30 <br />Public Improvements. <br />C. The Developer shall, subject to the terms and conditions contained herein, <br />31 <br />perform the following work and construct the following improvements (“Public Improvements”) in <br />32 <br />compliance with City approved Public Improvement Construction Plans described in Section III D <br />33 <br />below and all rules, regulations, standards and ordinances of the City: <br />34 <br />1.Site Grading and Turf Restoration. The Developer shall grade the Property in accordance <br />35 <br />with the Grading, Drainage and Erosion Control Plan. Site grading improvements shall <br />36 <br />include common excavation, subgrade correction, embankment and pond excavation. <br />37 <br />The Developer shall perform turf restoration on the Property which shall include seeding, <br />38 <br />mulching and erosion control. <br />39 <br />a)The Developer shall submit the Grading, Drainage and Erosion Control Plan prior to <br />40 <br />installation of the improvements. <br />41 <br />b)All improvements to the Property and the final grading shall comply with the <br />42 <br />Grading, Drainage and Erosion Control Plan. <br />43 <br />Page 1 of15 <br /> <br />
