d. <br />Vacation of the existing sewer easement and dedication of the proposed replacement sewer <br />61 <br />easement shall be addressed in conjunction with the Public Improvement Contract that will <br />62 <br />be required for the reconstruction of the sewer infrastructure related to those easements. <br />63 <br />The vacation has been approved, and a Notice of Completion will be issued once the sewer is <br />64 <br />realigned in the new easement as proposed. <br />65 <br /> <br />e. <br />The applicant shall pay park dedication fees in the amount of $3,500.00 per unit; <br />66 <br />The purchase agreement that pertains to both the Cherrywood Pointe and Applewood Pointe <br />67 <br />sites includes payment of $350,000 for park dedication fees (equal to 100 units at $3,500 per <br />68 <br />unit) for the Cherrywood Pointe development, which serves as a waiver of 100 units worth of <br />69 <br />park dedication fees from the total obligation of the development. Because the total number <br />70 <br />of units in the Cherrywood Pointe development is not specified as part of the final plat <br />71 <br />application, the balance of the park dedication fee for units in excess of 100 should be paid <br />72 <br />at the time building permits are issued. This condition does not require any specific action at <br />73 <br />this time, but is a recommended as a condition of final plat approval. <br />74 <br /> <br />f. <br />The applicant shall complete a traffic study for this project. The traffic study will be reviewed <br />75 <br />by, and any required mitigation efforts approved by, the City Engineer prior to the issuance of <br />76 <br />a building permit. <br />77 <br />The traffic study has been completed. No major ramifications from the proposed development <br />78 <br />were identified, but any required mitigations will be specified in the Public Improvement <br />79 <br />Contract. <br />80 <br /> <br />g. <br />The applicant is aware that any future variance requests will be reviewed on their merits, and <br />81 <br />the platting process does not have any impact on the variance process, if needed, in the <br />82 <br />future. <br />83 <br />This condition does not require any specific action at this time. No variances are being <br />84 <br />requested, and this is not a recommended condition of final plat approval. <br />85 <br />OC <br />THER OMMENTS <br />86 <br />Lot 2 Block 1 of the plat essentially comprises the City-owned portion of the subject property. <br />87 <br />The purchase agreement noted above will transfer this land to United Properties, but will grant <br />88 <br />an easement to Roseville in order to ensure access from Lexington Avenue to potential future <br />89 <br />developments south of the Cherrywood Pointe site. This access easement does not appear on the <br />90 <br />t need to; it would be accounted for in the purchase agreement. <br />91 <br />The recently-adopted tree preservation ordinance provided some options for meeting tree <br />92 <br />replacement obligations that remained when a tree replacement plan cannot reasonably <br />93 <br />accommodate the full amount of replacement trees on a development site. Specifically, the City <br />94 <br />can direct that some or all of the remaining replacement trees be planted on public lands, <br />95 <br />presumably in conjunction with public works projects or parks improvements, or the City can <br />96 <br /> in <br />97 <br />various places, as the need arises. <br />98 <br />Beyond the trees to be re-planted on site, United Properties is responsible for 1,298 remaining <br />99 <br />caliper inches of replacement trees. Assuming that replacement trees are equal to the 3-inch <br />100 <br />caliper minimum requirements, that would be 433 trees; further, if the City Council establishes a <br />101 <br />fee of $500 per tree, the equivalent fee in lieu of trees would be $216,500.
