B. Applicability <br />1. The re�ulations in this section shall apply to anv individual, business or entity that <br />applies for one of the below permits or approvals. <br />a. An application for plattin�, re-platting, or any lot division application that does not <br />qualify as a minor lot subdivision; or <br />b. A building permit application to construct a new Arincipal structure or seekin� to <br />expand the footprint of an existing principal structure by more than 50%; or <br />c. A demolition permit seekin� to remove more than 50% of a principal structure in <br />anticipation of immediate or future redevelopment; or <br />d. A�rading permit seekin� to add, move, or relocate 50 cubic yards or more in all non- <br />Shoreland Management Districts; or 10 cubic yards with the Shoreland Mana�ement <br />District. <br />2. If the Community Development Department determines that pre-application tree <br />removal occurred in order to circumvent the re�ulations in this section, the Department <br />ma_y require equivalent tree replacement as if a tree preservation plan had been <br />submitted prior to removal. Pre-application tree removal shall be considered removed <br />within two years of application. Any costs to estimate the removal mav be char�ed to the <br />applicant. Said determinations may be appealed to the Board of Adjustment and <br />Appeals under Section 1009.08 of this Title. <br />3. Activities subject to the provisions of Chanter 1017, Shoreland, Wetland, and Storm <br />Water Mana�ement, mav require tree preservation beyond that which is required bv this <br />section. In all such instances, the more restrictive preservation standard shall apply. <br />4. In all instances in which submissions bv a de�reed forester or certified arborist are <br />r_eguired, such submissions shall be reviewed and approved by City Staff or contractors <br />with equivalent credentials. <br />C. Exemptions <br />The following activities are exempt from the requirements of this Section: <br />l. Tree removal related to ��i citV public improvements projects or repairs; <br />2. Emergency removal of a tree or trees to protect public health. <br />D. Trees Required to be Inventoried <br />All deciduous trees measuring a minimum of six (6) inches at Diameter Breast Height (DBH), <br />and all coniferous trees that are twelve (12) feet or more in hei�ht, shall be identified on the <br />tree preservation plan sets required by this section. <br />E. Tree Classifications <br />All trees required to be inventoried shall be assi�ned a classification as follows: <br />1. Heritaae Trees: <br />a. All deciduous trees measuring equal to or greater than twenty-seven (27) inches at <br />DBH, and all coniferous trees measuring equal to or greater than fifty (50) feet in <br />hei�ht• <br />
