Consider Request by Vogel Mechanical for a Conditional Use (CU) to Allow <br />Limited Production and Processing at 2830 Fairview Avenue <br />Interim Community Development Director Kari Collins briefly reviewed the RCA <br />dated Apri1 11, 2016 detailing past action to-date for this property and current CU <br />request. <br />Ms. Collins summarized RCA detail on separate definitions in code clarifying ac- <br />cessory and primary uses for limited production and processing; reviewed land <br />use tables in all four CMU districts without distinction; staff's review of the Vo- <br />gel's business plan and staff's determination that the principle use remained gen- <br />eral office in every function and capacity with this limited production and pro- <br />cessing use ancillary. <br />Ms. Collins further reported that staff continued to have issues and concerns with <br />the purported easement agreement that could not be found. Ms. Collins reviewed <br />staff's aggressive research at Ramsey County for this documentation, with the on- <br />ly language found and included in tonight's packet to be the indenture dated in <br />1968 (Attachment E) with remaining debate as to how that particular language <br />addresses an easement. Ms. Collins reported that the result was staff's inconclu- <br />sive evidence that there was an easement agreement in place along the north <br />property line; and while recognizing there were overhead power lines could not <br />
