Consideration of a Community Development Department Request to Per- <br /> form an Abatement for Unresolved City Code Violations at 453 McCarrons <br /> Boulevard <br /> As previously noted, this item was removed from tonight's agenda due to its prior <br /> favorable resolution. <br /> d. Consideration of a Community Development Department Request to Per- <br /> form an Abatement for Unresolved City Code Violations at 405 Highway 36 <br /> Codes Coordinator Dave Englund summarized this request and provided updated <br /> photos of the code violations as of today for this currently unregistered single- <br /> family rental property at 405 Highway 36; with the property owner of record <br /> identified as Steve Sine. Mr. Englund reviewed current violations, originating <br /> from a numerous resident complaints, including building maintenance (407.02.B), <br /> debris (407.02.C), junk (407.03.I), and unregistered rental status (907.10). Mr. <br /> Englund estimated that the cost of abatement, encompassing repairs to and paint- <br /> ing of a shed, removal of junk and debris including brush and tree limbs, and ad- <br /> ministrative costs at approximately $2,125.00; in addition to an administrative fi- <br /> ne for an unregistered rental in the amount of$100.00. <br /> On the abatement list presented, Councilmember Etten noted that the windows <br /> shown on tonight's photos were not included. <br /> Mr. Englund responded that as of last week, the property manager disputed any <br /> and all violations and invited staff for an on-site follow-up inspection at which <br /> time staff was able to access the private property without trespass concerns, and <br /> observed additional violations (e.g. broken glass, etc.). Mr. Englund advised that <br /> those additional violations observed would require a separate and subsequent <br /> abatement process. <br /> Mayor Roe noted that his interpretation of the rental ordinance required a fine for <br /> each day of non-compliance for an unregistered rental property, asking staff's in- <br /> tent in suggesting a one-day violation and $100 fee. <br /> Mr. Englund advised that staff's intent was to assign the fine in order to incent the <br /> owner to get the property registered as a rental property. <br /> Mayor Roe provided an opportunity for the property owner to speak or to hear <br /> public comment at this time. <br /> Ron Ide 405 Highway 36 <br />
