Regular City Council Meeting <br /> Monday, October 9, 2017 <br /> Page 2 <br /> City Attorney Gaughan clarified that this was the verbatim language he had read <br /> back to the City Council at the previous meeting, adopted by the maker of the mo- <br /> tion and subsequently approved by the City Council. <br /> Councilmember Etten asked if the motion could be amended tonight; with City <br /> Attorney Gaughan recommending that the City Council not do so, as this action <br /> was simply memorializing that previous action and further advised that the appli- <br /> cant had already received a written recitation of those findings later that same <br /> week as City Council action had been taken. <br /> Willmus moved, McGehee seconded, adoption of Resolution No. 11456 (Attach- <br /> ment A) entitled, "A Resolution Memorializing the DENIAL of a Request for an <br /> Amendment to the Centre Pointe Planned Unit Development Agreement No. 1177 <br /> to Permit College or Post-Secondary School, Office-Based, as a Permitted Use at <br /> 2955 Centre Pointe Drive (PF 17-014)" as presented <br /> Councilmember Laliberte noted that she had been in the minority in supporting a <br /> PUD amendment, and therefore would not be supporting this motion either. <br /> Mayor Roe concurred that this was his position as well. <br /> Roll Call <br /> Ayes: McGehee, Willmus and Etten. <br /> Nays: Laliberte and Roe. <br /> Motion carried. <br /> 7. Business Items <br /> CLOSED SESSION MEETING <br /> Mayor Roe read a statement summarizing the intent of the closed session, and an- <br /> nounced that, in accordance with Minnesota State Statutes Chapter 13.D.05, subd. <br /> 3(b) and exceptions to Open Meeting Laws, he would entertain a motion to move <br /> into Closed Executive Session with the City Attorney and outside legal counsel to <br /> discuss potential settlement of litigation known as "Dorso Building Company, <br /> LLP v. City of Roseville" (Ramsey County District Court File No. 62-CV-17- <br /> 3275). <br /> McGehee moved, Etten seconded, recessing the City Council meeting at approx- <br /> imately 6:10 p.m. and convening in Closed Executive Session,per State Statute. <br /> Roll Call <br /> Ayes: Laliberte, McGehee, Willmus, Etten and Roe. <br /> Nays: None. <br /> CLOSED EXECUTIVE SESSION <br /> Mayor Roe convened the City Council in Closed Executive Session at approxi- <br /> mately 6:10 p.m. <br />
