Public Works Ordinance Updates <br /> City Engineer Freihammer briefly reviewed this request, which will update two <br /> different City ordinances: a noise ordinance and a right-of-way ordinance. <br /> Noise Ordinance <br /> The first proposal is to exempt City-led projects by eliminating the need for a <br /> public hearing for all City-lead projects. Instead of following an ordinance, the <br /> City would follow an established policy. Residents would be notified before the <br /> projects at minimum of one week prior to the project, along with the City Manag- <br /> er and the Mayor. In addition, mitigation techniques would continue to be used to <br /> ensure as minimal disruption as possible. <br /> Councilmember Etten thanked staff for responding to his questions earlier in the <br /> day. He also asked for clarification on the required notification for County-led <br /> projects. <br /> Mr. Freihammer confirmed that this expedited process would only apply to City- <br /> led projects. Projects led by MN-DOT, the County, or the Met Council would <br /> continue to have the same notification process; private developments also would <br /> not apply. <br /> Councilmember Etten noted he had previously asked that the ordinance language <br /> should more directly address the City policy. Consequently, staff came up with <br /> the following language for the Exemptions section: <br /> "Any exemptions for allowable working hours will follow the established <br /> Night Work Policy as adopted by the City Council including notification of <br /> the City Council and the impacted community. " <br /> Mr. Freihammer concurred that provides much clearer language. <br /> Councilmember Willmus expressed concern about ordaining and referencing pol- <br /> icy, which is something that can be changed easily and on a whim. He is unsure <br /> whether a change is necessary at all. He understands that sometimes there might <br /> be an issue with lead time,but he questioned whether that outweighed the public's <br /> enjoyment of their property or a conversation about the enjoyment of their proper- <br /> ty. In the current draft in the Council packet, new roofs could be put on at mid- <br /> night on a residential neighborhood. If a change is to be made, the type of work <br /> that needs to be accommodated should be referenced, rather than just referencing <br /> a policy. He is not sure that the existing method is so broken that it needs to be <br /> changed; it gives the public a chance to know what is going on. <br />
