Assess that portion of any unpaid charges which are attributable to the removal or <br />elimination of public health or safety hazards from private property pursuant to <br />Minnesota Statutes Section § 429.101. <br />h. Pursue any other legal equitable remedy which is available to the City. <br />The remedies listed in this ordinance are not exclusive of any other remedies <br />available under any applicable federal, state or local law and it is within the <br />discretion of the City to seek cumulative remedies. The Citv requires that stormwater facilities be <br />maintained. <br />1. Private Stormwater Facilities - All private stormwater facilities shall be maintained <br />a. Ponds. Stormwater Wetlands, and other non-structural devices <br />i Removal of settled materials - All settled materials from ponds, sumps, grit <br />chambers, and other devices, including settled solids, shall be removed and <br />properly disposed of on a five (5) vear interval. One (1) to five (5) vear <br />waivers from this requirement may be granted by the communitv when the <br />owner presents evidence that the facilitv has additional capacity to remove <br />settled solids in accordance with the original design capacity. <br />b. Infiltration. Filtration, Underground Storage, and other structural <br />devices <br />i Quarterlv inspections, unless otherwise specified in a maintenance agreement, <br />of the Private Stormwater Facilities and, if necessarv. removal of all litter, <br />debris, sediment, and replacement of mulch, vegetation, and eroded areas to <br />companv acceptable to the City that the Stormwater Facilities are functioning <br />in accordance with the approved plans and have maintained the proper <br />operation of the stormwater treatment as a Stormwater Management Facility <br />according to the City Standards. Maintenance plan required - No private stormwater facilities may be approved <br />unless a maintenance plan is provided that defines who will conduct the <br />maintenance, the type of maintenance, and the maintenance intervals. <br />3. Inspection - The Citv shall inspect all stormwater facilities during construction, <br />during the first year of operation, and at least once every five years thereafter, or as <br />budget allows. <br />4. Maintenance of Publiclv Owned Stormwater Facilities - The Citv shall annually <br />perform the maintenance of the in place stormwater facilities within the community <br />as provided for in the local water management plan or watershed management plan. <br />Further, the Citv shall notifv the owners of other publicly owned stormwater <br />facilities if scheduled maintenance is needed according to periodic site inspections or <br />maintenance plans on file. <br />B. Inventory of Stormwater Facilities. Upon adoption of this Chapter, the Citv shall <br />inventory and maintain a database for all private and public stormwater facilities within <br />communitv requiring maintenance to assure compliance with this ordinance.
