She was not sure if there was a pro- <br /> cess for something like this in the City of Roseville and if there is not a process, she <br /> would like to suggest there should be and she hoped the City would be transparent in let- <br /> ting people know of the outcome. <br /> Mr. Trudgeon stated in talking to the City Attorney, what was agreed to is there is a po- <br /> tential for a violation of the open meeting law, but it is not for the City to determine. It is <br /> a State law, so the City does not have any jurisdiction on that. He suggested Ms. Hilden <br /> contact the Department of Administration for an opinion on their part as to whether or not <br /> this was a violation. Beyond that, there is no direct action that the City can take. He also <br /> asked the City Attorney if there was any violation of the Ethics Code and he was told <br /> there was not. <br /> Ms. Hilden thought that seemed somehow inconsistent to her. She stated she did try to <br /> call the Department of Administration and got nowhere. She got into the loop of people <br /> not knowing who to refer her to so with more information, she would certainly pursue <br /> that. She thought if this is a State law there should be some sort of ethics violation. <br /> Mr. Trudgeon stated the Ethics Code governs behavior, not law. If there is a violation of <br /> law presumed, that means the City followed up through the normal codes and not the Eth- <br /> ics Code. That is the distinction. <br /> Ms. Hilden indicated that she still thought this was troublesome. <br /> 5. Recognitions,Donations, and Communications <br /> 6. Approve Authorization Agreement with the Roseville Area Youth Hockey <br /> Association for Operation of the Concession Stands at the Roseville Skating <br /> Center <br /> At the request of Councilmember McGehee, City Manager Trudgeon briefly high- <br /> lighted this item as detailed in the Request for Council Action (RCA) and related <br /> attachments dated October 8, 2018. He noted the City has had a hard time over <br /> the years finding a third party to run the concessions. The Hockey Association <br /> did approach the City and an arrangement was worked out that staff feels is mutu- <br /> ally beneficial with both parties. <br /> Councilmember McGehee stated the City has a number of these athletic associa- <br /> tions along with schools and a number of other organizations that come to the <br /> City asking for pull tabs and looking for ways to make money and if this clearly is <br /> a way to make money, she thought this was sort of unfair. If the City is going to <br /> make concessions at the Roseville Skating Center an option for community organ- <br /> izations to use as potential fundraisers then she thought it should be available to <br /> anyone who feels that their organization can meet the requirements of the City. <br /> She thought the City would have some reasonable requirements because this is on <br />
