He did not know if the <br /> City lawyer had looked at the lease carefully because it states in the lease that the <br /> terms are not to be revealed to anyone else but obviously because it is in the <br /> Council packet, it has been revealed to the public, which is a violation. The lease <br /> also states combustible items cannot be stored there but if vehicles are driven in, <br /> obviously gasoline will be in there. He knew the City had an understanding with <br /> the landlord, but it seems like those things should be in the lease, especially the <br /> part about telling third parties because the City does not want to be told leave <br /> three months from now for violation of the lease. <br /> Mr. Hess stated it seems like this has been a problem in the past with the City <br /> where more is being spent on leasing a building when a building could be pur- <br /> chased. He stated it would be nice if the City came up with a plan for Public <br /> Works and there is no reason to keep waiting. He noted multiple consultants have <br /> been hired over the years to look at space needs and none of the reports were ever <br /> used. It would be nice for someone to take the initiative because each year it be- <br /> comes more expensive. <br /> City Attorney Hartmann stated his law partner has looked at this lease in detail. <br /> With regard to storage of gasoline, the provision on hazard waste is standard and <br /> will be in any lease. Any small amount that would be in the facility would be <br /> minimal and not an issue. As far as the document not being given to other people, <br /> a lot of times this will be deleted out of a draft agreement, but he thought the take <br /> away was the City was not going to record the lease, which sometimes happens. <br /> Councilmember Willmus stated with regard to Fairview Fire Station, the City is <br /> still using that for storage. As the historical society moves out, there will be room <br /> downstairs as well. In the interim, one of the reasons he was supportive of acquir- <br /> ing one of the properties across the street is so that the City has that land should <br /> the City decide to move forward with expansion of Public Works storage facility. <br /> Those are conversations that the Council needs to start to have. The length of <br /> term here is something that gives him a little bit of pause, but the City needs, in <br /> the interim, to have some place to store City items. He was not sure if the length <br /> needs to be as long as this but those are some conversations the Council should <br /> have. He stated he was not expecting this item to come forward to the City Coun- <br /> cil on consent. <br /> Councilmember Laliberte concurred with Councilmember McGehee that the City <br /> has been talking about this a long time and there have been consultants that have <br /> brought forth different plans. She agreed the Council has not finished the conver- <br /> sation about space needs. She thought this item should be something on the grid, <br /> making sure it comes back before the Council. She thought the Council did need <br /> to discuss space needs further, noting that in years 4-6 with a 6-month notice, the <br />
