Regular City Council Meeting <br /> Monday, April 15, 2019 <br /> Page 10 <br /> public data, that if disclosed, carries with it a degree of likelihood on the part of a <br /> Government Agency of a threat of potential theft of property loss, property dam- <br /> age or other criminal activity and it is his interpretation that a vacant building reg- <br /> istry would fall under that data classification and would be his suggestion to staff <br /> to keep any sort of registry up for vacant buildings as private, not public data. <br /> Councilmember Willmus asked if there were any cases where that interpretation <br /> has been successfully defended. <br /> City Attorney Gaughan stated as far as he was aware, there has not been any con- <br /> test to that interpretation. <br /> Councilmember Willmus asked if this would be something that Roseville could <br /> seek an opinion from State Attorney General's office. <br /> City Attorney Gaughan stated the City can certainly seek an opinion from the De- <br /> partment of Administration itself. <br /> Councilmember Willmus stated he would like to know and have a firm under- <br /> standing of that background. <br /> Councilmember Groff stated under"Snowbirds" it states 180 days but asked what <br /> would happen if the individual stayed away longer. <br /> Mr. Englund stated this would be a reactive complaint-based program and notice <br /> would be sent to the property and go through the process. <br /> Councilmember Etten wondered if it would help in the Vacant Building defini- <br /> tion, page two, to outline if it is a multi-tenant building, all units would need to be <br /> empty, as a further piece. He stated it is implied in staff information but not in the <br /> actual language. <br /> Mayor Roe read the vacant building definition, noting under Item B, Vacant <br /> Buildings, it says that the property owner of record must register the vacant build- <br /> ing within thirty days of the building becoming vacant. He wondered if the thirty <br /> days was from the time the owner expected the building to be unoccupied or from <br /> within thirty days of the building actually being unoccupied for 180 days. <br /> Mr. England stated it would be within thirty days of it being vacant in excess of <br /> 180 days. <br /> Councilmember Etten asked if staff has thought about a fee level. <br /> Mr. Englund stated staff has been looking at it for about a year or so since starting <br /> this, for what actual costs staff would incur to actually register these buildings, <br />
