Regular City Council Meeting <br /> Monday,April 15, 2019 <br /> Page 9 <br /> the Statute reference in the report was incorrect. She suggested the City not use <br /> the word `variance' but instead use the word `deviation.' She stated staff wanted <br /> to make that change for clarity. <br /> Mr. Trudgeon stated in the Zoning Code there is a section which allows for Ad- <br /> ministrative Deviations to the Zoning Code to meet certain thresholds which does <br /> not rise to the level of a variance and is also administrative. There is also notice <br /> given to the neighbors in these cases but that does not happen a lot. <br /> Mayor Roe asked if it should state "administrative deviation," to be consistent <br /> with the language because he believed this is an administrative action and does <br /> not go before the City Council. <br /> Ms. Gundlach stated staff could use the term "administrative" in front of `devia- <br /> tion' except there is an appeal provision to the deviation that is administratively <br /> approved,but staff can fix that. <br /> Councilmember Laliberte stated she was supportive of not using the word `vari- <br /> ance' and letting the true sense of in use of the word variance stand. She was <br /> okay with the word `deviation' but wanted to make sure that however the words <br /> are organized, it does not make the organization look deviant. <br /> Mayor Roe stated there is one other section in City Code where variance is used, <br /> which is the noise standards in the Nuisance Code which is a Council action. He <br /> wondered if that is another place where staff would want to take out the word <br /> `variance.' He noted staff could review that and discuss with the Council at an- <br /> other meeting. <br /> Ms. Gundlach stated she would review this. <br /> Mr. Englund reviewed the last section of the report: Add requirements for regis- <br /> tering vacant buildings with the City Council. <br /> Councilmember Willmus asked how the City would deal with a multi-use, com- <br /> mercial building that is half empty. <br /> Mr. Englund stated if the building is occupied in any sense, he would not view <br /> this as being a part of this program. <br /> Councilmember Willmus asked how this information would be protected such <br /> that someone could not come forward to Community Development for access to <br /> vacant homes in Roseville. <br /> City Attorney Gaughan indicated staff did look at that and there is a provision un- <br /> der the Minnesota Government Data Practices Act that labels data as private, non- <br />
