Regular City Council Meeting <br /> Monday,June 17, 2019 <br /> Page 9 <br /> two would state that all other activities associated with the variance shall cease by <br /> 11:00 p.m. <br /> Ms. Gundlach noted in the second whereas clause the last sentence of that para- <br /> graph "The project is expected to take one to five days", did the Council want to <br /> leave that in place or specify a limit on the number of days, noting that it will be <br /> very difficult to enforce. <br /> Councilmember Etten indicated he would not change that. He indicated he would <br /> accept the other changes suggested by staff <br /> Councilmember Laliberte agreedas the seconder of the motion. <br /> Council Discussion <br /> Councilmember Etten thought everything has been covered and would allow all <br /> of the work to get done. <br /> Councilmember Laliberte thought this is better than denying it altogether in order <br /> to move the project forward and to completion as quickly as possible. <br /> Councilmember Groff agreed and thought it was middle ground where everyone <br /> was giving a little bit. He hoped it would not disrupt the community too much <br /> because the project needed to be completed as soon as possible for the businesses <br /> there. <br /> Councilmember Laliberte noted she found it troubling that none of the tenants <br /> came to the meeting to indicate how dire this would have been for them, so the <br /> City is left a little bit with thinking for them. She thought it would have been nice <br /> to have heard from the tenants as well as the residents around this project. <br /> Mayor Roe asked if notification went out to all property owners and tenants with- <br /> in the distance. <br /> Ms. Gundlach indicated the City notified property owners which is what is re- <br /> quired under City Ordinance, however, in recognition that there are many rental <br /> properties, the City posted notices at the residential rental properties. Notice was <br /> not provided to every individual commercial tenant, relying on the property owner <br /> to communicate that. <br /> Mayor Roe asked if there was a different notification for noise variances then for <br /> a land use. <br /> Ms. Gundlach the variance process does not specify if the City is supposed to be <br /> notifying tenants, it only states property owners. <br />
