Regular city Council Meeting <br /> Monday,July 22, 2019 <br /> Page 9 <br /> Community Development Director Janice Gundlach explained the Council can <br /> place an end date the Council deems to be appropriate. The Council could do an <br /> end date of September/October to try to get the project through the beginning <br /> phase and if there are not any complaints, that would be a good indication that the <br /> applicant could re-file. She would not worry about the cost in this particular situa- <br /> tion because the applicant can bear the cost to go through the process again. An- <br /> other point to note, is that Ryan Companies is a good contractor so if after the <br /> Council grants the variance and there are complaints, staff would engage with the <br /> contractor to try to figure out what the complaints are to see if there is a remedy <br /> outside of the variance process. <br /> Councilmember Groff asked if staff or Ryan Companies be willing to work with <br /> the hotels if there was an issue with that because that is his concern. <br /> Ms. Gundlach indicated staff would be willing to do that. If the variance is grant- <br /> ed all the way to July 2020, she did not know that the City would have a legal <br /> remedy to force Ryan Companies to stop, which is why the Council might want to <br /> go back to maybe a trial period of four months. If there are no complaints, then <br /> Ryan Companies can re-apply. <br /> Ms. Gundlach noted the Council has the option of waiving the fee but would not <br /> necessarily do that and Ryan Companies would need to cover the cost to prepare <br /> the staff report, do the public hearing, and notify the neighbors. <br /> Mayor Roe thought another option the Council has would be to adjust the hours <br /> that are being proposed if approved. <br /> Ms. Gundlach indicated that was correct. <br /> Councilmember Groff noted he was leaning towards some type of shorter period, <br /> such as four months, to see what happens and he would probably leave the time <br /> the same as recommended now but could change it if there are complaints as well. <br /> Councilmember Etten thought by four months the noisy part of the project would <br /> be done and is a moot point. He suggested either a shorter trial period or shorten <br /> the hours. <br /> Mayor Roe thought the challenge the City always has is if the applicant is making <br /> a bunch of noise on a Saturday morning and then during the rest of the period <br /> there is no noise made, where the City would be at in terms of dealing with en- <br /> forcement. <br /> Councilmember Groff asked if staff talks to the hotels to let them know about the <br /> extended hours. <br />
