Regular City Council Meeting <br /> Monday, August 26,2019 <br /> Page 7 <br /> Councilmember Willmus indicated he was not worried about this party but if the <br /> developer goes away and the property has been subdivided, he is looking at <br /> mechanisms that the city could assure proper dedication. <br /> Ms. Gundlach indicated the Council can approve the preliminary plat and condi- <br /> tional use and table the final plat until a point in time that the developer is ready <br /> to move forward and able to pay the park dedication. She knows the applicant has <br /> a situation where the property is set to close at the end of the month. <br /> Mr. Brasser explained it is set to close at the end of this week and there is not time <br /> to table the final plat. <br /> Ms. Gundlach indicated staff has encouraged the applicant to seek a delay in the <br /> closing, but she does not know what discussions the applicant has had with the <br /> seller and the seller's receptiveness to the delay. <br /> Mr. Brasser explained this is actually an extended closing timeline and later than <br /> what was originally entered into the contract so it cannot be extended any further. <br /> Councilmember Laliberte asked if there was any way to divide the $508,000 be- <br /> tween the time of plat and time of building permit. <br /> City Attorney Gaughan thought the city would still run into the same problem of a <br /> significant outstanding balance. He did not know if that would solve the problem. <br /> Councilmember Etten indicated he was thinking the same thing and thought the <br /> city could ask for half of the park dedication at final plat approval. <br /> Councilmember Laliberte asked if the fee had to remain worded as an amount per <br /> dwelling unit. <br /> City Attorney Gaughan indicated it did. <br /> Willmus moved, Etten seconded, adoption of Resolution No.11629 entitled, <br /> "Resolution Approving the Proposed Fairview Avenue Addition Preliminary Plat, <br /> amending condition C to read `prior to issuance of any city permits for develop- <br /> ment of Lot 1, Block 1, Fairview Avenue Addition, a dedication of cash in lieu of <br /> park land shall be paid in the amount of$508,000' (PF19-016)." <br /> Council Discussion <br /> Councilmember Willmus thought the amendment made sense for the preliminary <br /> plat. He did not like seeing closings pushed out because it created problems down <br />
