The restaurant has been compliant since the City of Ro- <br /> seville mandated alcohol education. <br /> Mr. Jackson indicated in March 2019, he was promoted to area director and at that <br /> time he handed the restaurant over to Mr. Anderson, a 21-year veteran of the <br /> company, but neglected to education Mr. Anderson on Roseville's required pro- <br /> cedure on alcohol compliance. The reason why Famous Dave's is not up-to-date <br /> on documentation is that Mr. Anderson was not aware of the system. He noted <br /> Mr. Anderson is now fully aware and will see that the proper training and docu- <br /> mentation is in place. He noted it is hard to find responsible and qualified staff <br /> and the restaurant is faced with challenges of no shows and turnover is at an all <br /> time high. Mr. Anderson will continue to be the one doing all orientations and <br /> seeing to it that all new hires are educated and is also committed to talking about <br /> this topic daily with staff. <br /> Mr. Jackson reviewed the alcohol compliance failure with the Council and indi- <br /> cated management takes full responsibility for the failure. He requested the <br /> Council to look at Famous Dave's past record and be lenient on the decision in <br /> regard to the penalty. <br /> Mayor Roe appreciated management being at the meeting and taking the issue se- <br /> riously. <br /> Councilmember Willmus appreciated Famous Dave's for coming in and giving <br /> background to the Council. He was one of the Councilmembers that was on the <br /> Council when the city took a second look at the penalty and fine process and put <br /> them into place. The city has had a few instances where a long-time business had <br /> a violation come forward and he did not recall ever deviating from the city's set <br /> fine penalty schedule. He appreciated the ask but from his perspective, would be <br /> looking to hold to what the city has set forward in code with regard to suspension <br /> and fine structure. <br /> Willmus moved, Etten seconded, approval to allow the Roseville Police Depart- <br /> ment to issue and administer the presumptive penalty as set forth in Section <br /> 302.15, of the Roseville City Code. <br /> Council Discussion <br /> Councilmember Etten concurred with Councilmember Willmus' statement as this <br /> is something the city takes very seriously and needs to make sure to be consistent <br /> with the penalty. <br /> Mayor Roe added the city itself, at one point under its enforcement, was found to <br /> have served to a minor and assessed itself the full penalty and paid the penalty at <br />
