Regular City Council Meeting <br /> Monday, October 21, 2019 <br /> Page 5 <br /> Mayor Roe offered an opportunity for public comment, with no one coming for- <br /> ward. <br /> Laliberte moved, Etten seconded, to direct Community Development staff to <br /> abate the nuisance conditions at 2799 Merrill St as outlined in the staff report. <br /> Roll Call <br /> Ayes: Willmus, Groff, Etten, Laliberte and Roe. <br /> Nays: None. <br /> d. Consider Adopting a Resolution Approving an Amusement Area as a Condi- <br /> tional Use <br /> Senior Planner Bryan Lloyd briefly highlighted this item as detailed in the Re- <br /> quest for Council Action and related attachments dated October 21, 2019. <br /> Councilmember Willmus asked if the Conditional Use is granted, could it be <br /> granted in such a manner that it is limited to the suite that is occupied by this <br /> business or is it something that could potentially be considered Conditional Use as <br /> applying to the entirety of the property at 1955 County Road B2. <br /> Mr. Lloyd indicated the Planning Commission asked that same question and staff <br /> recommendation in the draft resolution discussed the proposed use, which is in a <br /> prescribed space within that building. In concept it could apply to that whole <br /> property but because the proposal is for that one space, the approval, if granted, <br /> would apply to that one space as diagramed. <br /> Mayor Roe asked from a land use perspective, if there was not a requirement in <br /> the business regulations for the Conditional Use approval would this use be an <br /> approved use under the city zoning analysis. <br /> Mr. Lloyd explained there were some discussions about that and there are two dif- <br /> ferent ways that it could be looked at and discussed. One of those ways is that the <br /> Zoning Code does not say anything about using virtual reality as an entertainment <br /> use and when the Zoning Code does not say something, then it is not permitted. <br /> The other way to approach it is the activity is not materially different from other <br /> things that are done on a commercial property, which is the way staff used to de- <br /> termine the use. <br /> Mr. Anton Torres, Strange Stars Entertainment, explained DreamTrace, Inc. is <br /> one of the businesses that is being launched and is a family run venture capital <br /> firm. He explained the process and endeavor about virtual reality and how the <br /> business will be run. He indicated he was at the meeting to answer questions. <br /> Mayor Roe offered an opportunity for public comment, with no one coming for- <br /> ward. <br />
