Regular City Council Meeting <br /> Monday, November 25, 2019 <br /> Page 12 <br /> Mr. Freihammer explained it only serves access to one property owner, could cer- <br /> tainly function as a driveway, and is not up to any current standards. If it were <br /> brought up to the standard, the property would be assessed. An additional note, <br /> there have been complaints about the way parking has been posted but staff does <br /> regulate parking in that corridor. <br /> Willmus moved, Groff seconded, adoption of 11650 entitled, "Resolution Ap- <br /> proving the Vacation of a Portion of County Road B Lying West of Minnesota <br /> Trunk Highway 280." <br /> Council Discussion <br /> Councilmember Etten thought this was something that does not function as a pub- <br /> lic right-of-way or usage and the city does not have a need or responsibility to <br /> maintain that. <br /> Mayor Roe indicated the property would revert back to the property owner to use <br /> as they see fit and the point has been well made that this does not serve a public <br /> purpose anymore so there really is not a justification for the city to continue to <br /> have this right-of-way as a part of city property. He explained that from his point <br /> of view, there is justification as to why the city should vacate this right-of-way. <br /> He noted this is not retaliation for going to the city and asking about it, but the <br /> city was obligated by law to not maintain the right-of-way that would not serve a <br /> public purpose. <br /> Roll Call(Super Majority Required) <br /> Ayes: Laliberte, Etten, Willmus, Groff and Roe. <br /> Nays: None. <br /> e. Public Hearing to Consider Resolution Approving the Vacation of County <br /> Road B East of Trunk Highway 280 <br /> City Engineer/Assistant Public Works Director Jesse Freihammer briefly high- <br /> lighted this item as detailed in the Request for Council Action and related attach- <br /> ments dated November 25, 2019. <br /> Mr. Trudgeon updated the Council on the publication notice. <br /> Mayor Roe reviewed public hearing protocol and opened and closed the public <br /> hearing at approximately 7:41 p.m. for the purpose of receiving public input on <br /> the above-referenced Vacation of County Road B East of Trunk Highway 280; <br /> with no one appearing for or against. <br /> Mayor Roe closed the public hearing at approximately 7:42 p.m. <br />
