If it were brought up to the standard, the property would be assessed. An additional note, there have been complaints about the way parking has been posted but staff does regulate parking in that corridor. Willmus moved, Groff seconded, adoption of 11650 entitled, "Resolution Ap- proving the Vacation of a Portion of County Road B Lying West of Minnesota Trunk Highway 280." Council Discussion Councilmember Etten thought this was something that does not function as a pub- lic right-of-way or usage and the city does not have a need or responsibility to maintain that. Mayor Roe indicated the property would revert back to the property owner to use as they see fit and the point has been well made that this does not serve a public purpose anymore so there really is not a justification for the city to continue to have this right-of-way as a part of city property. He explained that from his point of view, there is justification as to why the city should vacate this right-of-way. He noted this is not retaliation for going to the city and asking about it, but the city was obligated by law to not maintain the right-of-way that would not serve a public purpose. Mr. Trudgeon updated the Council on the publication notice. Mayor Roe reviewed public hearing protocol and opened and closed the public hearing at approximately 7:41 p.m. for the purpose of receiving public input on the above-referenced Vacation of County Road B East of Trunk Highway 280; with no one appearing for or against. Mayor Roe closed the public hearing at approximately 7:42 p.m.
