Public Hearing to Consider Resolution Approving the Vacation of Drainage <br /> and Utility Easements and Accepting the New Drainage and Utility Easement <br /> and Pathway Easement at 3015 Centre Pointe Drive <br /> City Engineer/Assistant Public Works Director Jesse Freihammer briefly high- <br /> lighted this item as detailed in the Request for Council Action and related attach- <br /> ments dated November 25, 2019. <br /> It was noted there was one objection from the property owner adjacent to this <br /> easement. <br /> City Attorney Gaughan explained to make the record clear, there are two ways to <br /> vacate an easement, one is on a petition signed by all interested property owners <br /> or on the city's own motion. There is not a petition from all interested property <br /> owners on this item so if the city is interested in vacating this easement, it would <br /> need to be on the city's own motion so he would recommend on Attachment A, <br /> which is the proposed draft Resolution, to change line 29-30 as follows: "Whereas <br /> the Roseville city Council has determined that the vacation would be in the public <br /> interest; and therefore makes this resolution upon its own motion." <br /> Councilmember Etten explained some of the concern from the adjoining property <br /> owner was around loss of green space and ponding was mentioned. He wondered <br /> if there was ponding at all or just on the southern property. <br /> Ms. Freihammer showed a layout of the existing basin. He noted the basin is es- <br /> sentially split in half, providing storm water treatment and storage on both proper- <br /> ties so there would still be roughly half a pond remaining as a part of this. There <br /> is technically less green space. <br /> Councilmember Etten asked if there was any planting or landscaping require- <br /> ments with this. <br /> City Planner Paschke indicated a landscape plan came in as a part of the devel- <br /> opment project and is required for the whole site. This site meets the PUD for the <br /> standard of green space as required for the whole site. Turning the pond into un- <br /> derground stormwater storage still achieves compliance with the PUD as per the <br /> requirements in there. He believed the south pond does have some landscaping. <br />
