ATTACHMENT C <br />223 shall be permitted to approve appropriate testing procedures performed by an approved <br />224 agency. <br />225 b.Test reports.Reports of tests shall be retained by the code official for the <br />226 period required for retention of public records. <br />227 4. Used Material and equipment reuse. Materials that are reused shall comply with <br />228 the requirements of this code for new materials. Materials, equipment and devices <br />229 shall not be reused unless such elements are in good repair or have been reconditioned <br />230 and tested when necessary, placed in good and proper working condition and approved <br />231 bythe code official. <br />232 5. Approved materials and equipment. Materials, equipment and devices approved by <br />233 the code official shall be constructed and installed in accordance with such approval. <br />234 6. Research reports. Supporting data, where necessary to assist in the approval of <br />235 materials or assemblies not specifically provided for in this code, shallconsist of valid <br />236 research reports from approved sources. <br />237 F.Violations <br />238 1. Unlawful acts.It shall be unlawful for a person, firm or corporation to be in conflict <br />239 with or in violation of any of the provisions of this code. <br />240 2. Notice of violation. The code official shall serve a notice of violation or order <br />241 in accordance with Section906.03.G. <br />242 3. Prosecution of violation. Any person failing to comply with a notice of violation or order <br />243 served in accordance with Section 906.03.G. shall be deemed guilty of a misdemeanoror <br />244 civil infraction as determined by the local municipality, and the violation shall be deemed <br />245 a strict liability offense. If the notice of violation is not complied with, the code official <br />246 shall institute the appropriate proceeding at law or in equity to restrain, correct or abate <br />247 such violation, or to require the removal or termination of the unlawful occupancy of the <br />248 structure in violation of the provisions of this code or of the order or direction made <br />249 pursuant thereto. Any action taken by the authority having jurisdiction on such premises <br />250 shall be charged against the real estate upon which the structure is located and shall be a <br />251 lien upon such real estate. <br />252 4. Violation penalties. Any person, business, organization or entityfirm or corporationwho <br />253 shall violate anyaprovision of this code, or fail to comply therewith, or with any of the <br />254 requirements thereof, shall be guilty of a misdemeanor and upon conviction thereof, shall <br />255 be punished as a misdemeanor offense prosecuted within the limits provided by state or <br />256 local laws. Each day upon which that a violation continues, after due notice has been <br />257 served, shall be deemed a separate offense. <br />258 5. Abatement of violation. The imposition of the penalties herein prescribed shall not <br />259 preclude the legal officer of the jurisdiction from instituting appropriate action to <br />260 restrain, correct or abate a violation, or to prevent illegal occupancy of a building, <br />261 structure or premises, or to stop an illegal act, conduct, business or utilization of the <br />262 building, structure or premises. <br />263 G. Notices And Orders <br />264 1. Notice to personresponsible party.Whenever the code official determines that there <br />265 has been a violation of this code or has grounds to believe that a violation has occurred, <br />266 notice shall be givenin the manner prescribed in Sections906.03.G.2. and 906.03.G.3 to <br />267 the person responsible partyfor the violation as specified in this code. Notices for <br />268 condemnation procedures shall also comply with Section 906.03.H.5. <br />6 <br /> <br /> <br /> <br />
