Contaminated carts or dumpsters of material will not be collected, and a tag will be left <br />indicating the reason the material is unacceptable. The Contractor shall also notify the City <br />Recycling Coordinator within one business day by pkexe-email that the material was left and the <br />reason that the material was unacceptable. It will be the responsibility of the Contractor to obtain <br />cooperation from the building owner/ma ger in removal of trash and separation of acceptable <br />materials so that the carts can be serviced. The Contractor shall provide the City with a mirdmum <br />of one month's notice of any multi-urdt education campaign plans. <br />In Section 2.7— Proposer would like further clarity on this section. For example, if the City <br />decides to change set out requirements to include walk up for all residents, this would be a <br />change in service level and would require a price change. Current language makes it sound like <br />City could make such change and the proposer would like some limits set on this right. <br />Section 2.13 Severe Weather— Proposer suggests deleting the first sentence and replacing it <br />with the following: <br />"Recycling collections may be postponed due to severe weather upon mutual agreement between <br />contractor and Public Works Director. If decision to postpone is outside of normal operational <br />hours, contractor will attempt to reach Public Works Director by phone and email. If a response <br />is not received and due to safety a decision needs to be made, the contractor will postpone <br />collections". <br />3.7 Contractor's Customer Service Call Center Staff— proposer suggests the following <br />tracked change: <br />The Contractor shall have on duty Monday through Friday from 78.00 a.m. to 5:00 p.m. <br />customer service representatives to receive customer calls. In addition, the Contractor shall have <br />an answering machine or voice mail system activated to receive phone calls after hours 24 hours <br />per day, 7 days per week, 365 days per year. <br />5.5 Liquidated Damages —proposer suggests the following tracked changes: <br />This Contract establishes liquidated damages as an exclusive remedy for failure to meet the <br />6e'ee performance standards set forth in this Section 5.5. These liquidated damages <br />are independent of dgfauktand-hreasl}provisions governing other defaults and breaches of the <br />parties addressed elsewhere in this Contract. <br />. This list may be amended by mutual written <br />agreement between the City and Contractor as needed. <br />The City and Contractor expressly agree that the potential harm or injury to the City or residents <br />caused by the incidents of substandard performance set forth in this Seakast-Section 5.5 are <br />difficult or impossible to accurately estimate. The City and Contractor stipulate that each damage <br />dollar amount in this Section 5.5 6enkapt is a reasonable estimate of the loss to the City and the <br />public. <br />
