Continued Page 2.

323

Membre~ moved, Hammersten seconded, that the petition for vacating the
following described property be granted.

A twelve foot lane sep~rating Lots 14 and 15, Block 3,
C. W. Michael's Addition and Lot 1, Block 3, It.W. lIichael's
Addition and Lot 3, Lee Addition

Roll call Ayes-(5) N~es-(O).

The hearing on petition of Midwest Realty Company for rezoning property in
Section 9 was declared open. Mr. Loftsgaarden spoke for the people in Bolstad's
Addition. There wern two matters for consideration - the rezoning and the sP.t-
backs as ~8ked for. Loftsgaarden proposed that an additional 125 ft. south of the
75 feet already asked for be rezoned for business purposes except the construction
of buildings, and that the planting of trees consist of two rows, one of them to
be pine. He also asked if trees could be planted on the West side of the Bolstad
Addition under the supervision of the Village Council.

He said the peopl~ C8~~ ~ut to Roseville to live peacefully and they have
clOGe to one-half million dollars in valuation and have confidence that the
Village Council would protect them against rezoning of things that may hurt them in
the re-sale of their homes. Under present plans, there may be a loss of $5,000
in the sale of their homes. These people have faith in the plans of the Midwest
Realty Co. and feel they should not object to the additional set-back requirements
if they are sincere in not wanting to hurt the present 'residents who were here first.
The people feel they should be protected, as the petitioners have plenty of room
and will not build right up to the property lines that they have acquirfld.

Mr. Loftsgaarden suggested that 15 ft. along Fry from Brooks to Bruce in
Bolstad Add! tion be acquirod so the snow plow! can do a better job of snow removal,
as it is now only a 30 ft. road and the snow has been piled up at the intersections
on property ~~ers yards.

Mr. Hammond of Westmoor Addition wanted to \mow if the owner~ were Allied
Stores or the Midwest Realty Co. Mr. Costello, counsel for the petitioners, said
'" the Golden Rule wa5 part of the Allied Stores and the Midwest Realty Co. was a
companion Company. Mr. Hammond said they have no idea what was going in on the
property and inquired if their petition for a larger area had been presented to
the Allied stores. Mr. Costello, who represented the petitioners, said he was
acting in a limited capacity and coulð not answer all the questions that ma.y be
asked.

He stated the Allied Stores have purchased property in Roseville and should
be considered property owners. Residents have a right to certain protection.
The petition asks for rezoning of the entire tract, and protection is glven the
residents by set-backs established by the Village Council which the petitioners
hoped would be reasonable and fair and would be adequate for the residents.

Mr. Hammond said he was sorry they did not ask for 250 feet for protection
instead of the 130 feet compromise submitted. The petition was brought out and
the map gone over by Mr. Hanunond and Mr. Heimbach, shoWing the requests they have
asked for. Lauric Road is only a 30 foot read which was dedicated by the previous
owner.
