33 employee must be absent, or is unable to work (including telework) due to a COVID-19 health- <br />34 related reason as outlined in the attached policy, they will receive a bank of Emergency Pandemic <br />35 Leave hours to be used for those specific COVID-19 related situations. <br />36 <br />37 First Responders are eligible for up to 80 hours (Firefighters are eligible for up to 6 shifts covered <br />38 under this policy) and all other benefit eligible employees are eligible for up to 40 hours. These <br />39 hours are not available to be carried over into a new benefit year, nor will any unused hours be <br />40 paid out to employees. <br />41 <br />42 The accrual and use of leave are terms and conditions of employment and therefore subjects of <br />43 collective bargainingand therefore a Memorandum of Understanding (MOU) is needed as an <br />44 addendum to the bargaining contract. Staff has reached out to each of our collective bargaining <br />45 groups and presented this proposal to them. Each group has indicated their support for the MOU <br />46 agreement. <br />47 P OLICY O BJECTIVE <br />48 To continue providing services while keeping both residents and employees safe. <br />49 B UDGET I MPLICATIONS <br />50 There is no immediate financial impact as wages (including any paid leave time) are budgeted <br />51 on an annual basis. <br />52 S TAFF R ECOMMENDATION <br />53 Staff recommends authorizing the Mayor and City Manager to enter into an MOU agreement <br />54 for Emergency Pandemic Leave beginning April 13, 2020 – December 31, 2020 for the <br />55 following bargaining units: <br />56 1. Law Enforcement Labor Services (LELS) Local 112 –Police Officers <br />57 2. Law Enforcement Labor Services (LELS) Local 436 – Police Sergeants <br />58 3.
