Attachment A <br />1 AMENDMENT <br />2 TO <br />3 PUBLIC IMPROVEMENT CONTRACT <br />4 TWIN LAKES 3RD ADDITION <br />5 <br />6 <br />7 I. Parties. This Amendment, dated ________________, 2020, is entered into between the <br />8 City of Roseville, a Minnesota municipal corporation (“City”), and Roseville Investment <br />9 Partners, LLC, a Minnesota limited liability company (“Developer”). <br />10 <br />11 II.Recitals. <br />12 <br />13 A. The Developer has platted real property owned by the Developer in the City of Roseville <br />14 into the plat known and referred to as “Twin Lakes 3rd Addition” (“Plat”). <br />15 <br />16 B. The Plat is comprised of real property legally described as follows: <br />17 <br />18 Outlot A, Twin Lakes 3rd Addition, Ramsey County, Minnesota (the “Property”). <br />19 <br />20 C. In connection with the execution and recording of the Plat, the Developer and the City <br />21 duly entered into a Public Improvement Contract Twin Lakes 3rd Addition, dated July <br />22 15, 2020, which was filed in the office of the Ramsey County Recorder on July 29, 2020 <br />23 as Document No. A04824572 (the “PIC”). <br />24 <br />25 D. The Developer and the City have agreed, subject to the parties entering into this <br />26 Amendment, that the City may acquire approximately 40,000 cubic yards of clean fill <br />27 material from the Developer’s contractor, which material will be stockpiledon the <br />28 Property. <br />29 <br />30 E. The parties desire to amend the PICto accommodate the stockpiling of material referred <br />31 to herein and to provide for other matters set forth herein. <br />32 <br />33 NOW THEREFORE, in consideration of One Dollar ($1.00) and the mutual covenants <br />34 agreements and conditions contained herein, the parties hereby supplement and amend the PIC as <br />35 follows: <br />36 <br />37 1. Stockpile. The City may acquire from the Developer, through the <br />38 Developer’s contractor, approximately 40,000 cubic yards of clean fill <br />39 material, which will be stockpiled on the Property as follows: <br />40 <br />41 a. The City will contract separately with the Developer’s contractor, <br />42 which will stockpile the material on the Property in approximately the <br />43 location shown on Exhibit A, attached hereto. <br />44 <br /> <br />
