ATTACHMENT D <br />1 <br />2 a.Consider Draft Ordinance Regarding Rental Registration and Short-Term <br />3 Rental Licensing <br />4 Community Development Director Janice Gundlachbriefly highlighted this item <br />5 as detailed in the Request For Council Actionand related attachments dated January <br />6 11, 2021. <br />7 <br />8 Councilmember Strahan stated she needed to better understand what the City’s goal <br />9 is because in what is being sent forward, reading what people are asking of the City, <br />10 what concerns they have, and in looking at other constituencies and municipalities, <br />11 short term rental rules and regulations, it does not seem like the City is at that phase. <br />12 If the City is looking at specifics, like a physical, visual demarcation of property <br />13 lines, to her it seems it would need a lot more detail from what has been provided. <br />14 She requested more information. <br />15 <br />16 Ms. Gundlach thought staff’s understanding last year was that the Council wanted <br />17 a regulatory tool in place to take care of essentially three properties that have been <br />18 problem short-term rentals. Staff noted the two ordinances included in the packet <br />19 provide the necessary regulatory tool to take away a privilegeif the owners of the <br />20 properties are not taking care of them. She thought there was someconcern about <br />21 the 550 registered rentals, 24 listings on the short-termsites, and many of those are <br />22 operating without any problem. She thought there was also a desire to try and allow <br />23 those to remain. She statedif the Council does not like the two ordinances that are <br />24 included in the packet, staff would need to understand what path the Council wants <br />25 to go on. Her understanding, based on the two prior meetings, was that the City <br />26 was at the detail phase and looking for comments on the specific ordinance lan- <br />27 guage. <br />28 <br />29 Councilmember Strahan indicated she wanted to contest that there are more than <br />30 three properties. She knew one was on her block and is not currently on a VRBO <br />31 site but last year, when it was, a tiny three-bedroom home was listed for occupancy <br />32 of sixteen people. She reviewed the issues with the Councilalong with specific <br />33 regulatory issues. <br />34 <br />35 Mayor Roe thought part of the previous discussion was certain factors related to <br />36 these properties are already regulated inthe nuisance code, which applies to all <br />37 properties. He noted one question that came up was to what extent does the City <br />38 expect these businesses to follow. The thing the City is trying to get at with short- <br />39 term rentals is to clean it up, make a number of things clearer,and more able to be <br />40 enforced. He indicated that Chapter 909gets to the notion of licensing absentee- <br />41 owned single-family homes that are being rented on a short-term basis as a busi- <br />42 ness. <br />43 <br />44 Councilmember Willmus thanked staff for the effort to get the City where it is at <br />45 this point. He thought much of this is in line with whathe wanted to see in the City. <br />46 The one area where it might be coming up a little bit short is with the minimum <br />47 stay. He wantedto be assured that the date the Council comes up with will catch <br />48 at least two weekends and he was not quite sure that a minimum stay of seven <br /> <br />
