Chapter 306 of the Roseville City Code is amended to read as follows: <br />15 <br />16 <br />17 SECTION: <br />18 306.01: Findings of Fact and Purpose <br />19 306.02: Definitions <br />20 306.03 : License Required <br />21 306.04 : ApplicationFees <br />22 306.05 : Prohibited SalesBasis for Denial of a License <br />23 306.06 : Indoor Smoking Prohibited Sales <br />Formatted: Right: 2.96" <br />24 306.07 IdentificationResponsibility <br />25 306.08 : EnforcementCompliance Checks <br />26 306.09 : Violations and Penalties <br />27 306.10: SeverabilityExceptions and Defenses <br />28 306.11: Severability <br />29 306.12: Effective Date <br />30 <br />31 306.01 : FINDINGS OF FACT AND PURPOSE:. <br />32 Because the city recognizes that the sale of commercial tobacco, tobacco-related devices, <br />33 electronic delivery devices, and nicotine or lobelia delivery products to persons under the age <br />34 of 21 violates both state and federal law; and because studies, which the city accepts and <br />35 adopts, have shown that high school use of any commercial tobacco product has increased to <br />36 27.6% in Minnesota; and because nearly 90% of people who smoke begin smoking before <br />37 they have reached the age of 18 years, and that almost no one starts smoking after age 25; and <br />38 because marketing analysis, public health research, and commercial tobacco industry <br />39 documents reveal that tobacco companies have used menthol, mint, fruit, candy, and alcohol <br />40 flavors as a way to target youth and young adults and that the presence of such flavors can <br />41 make it more difficult to quit; and because studies show that youth and young adults are <br />42 especially susceptible to commercial tobacco product availability, advertising, and price <br />43 promotions at tobacco retail environments; and because commercial tobacco use has been <br />44 shown to be the cause of many serious health problems which subsequently place a financial <br />45 burden on all levels of government, this ordinance is intended to regulate the sale of <br />46 commercial tobacco, tobacco-related devices, electronic delivery devices, and nicotine or <br />47 lobelia delivery products for the purpose of enforcing and furthering existing laws, to protect <br />48 youth and young adults against the serious health effects associated with use and initiation, <br />49 and to further the official public policy of the state to prevent young people from starting to <br />50 smoke, as stated in Minn. Stat. § 144.391, as it may be amended from time to time. <br /> <br /> <br />
