REQUEST FOR COUNCIL ACTION Date:February 28, 2022 Item No.: 10.e Department ApprovalCity Manager Approval th Item Description:Adopt aResolution approving the Preliminary Plat of Twin Lakes 4Addition (PF21-020) 1 B ACKGROUND 2 The applicant proposes to subdivide the existing outlot into five lots to facilitate commercial 3 development. The existing parcel, legally described as Outlot A, Twin Lakes Third Addition, was 4 created through a Minor Plat as a component of the Dominium residential development of The Oasis 5 and The Harbor. The goal at that time was to reserve a portion of the site for future commercial 6 development. The property is zoned Community Mixed Use (MU-2B), which does not have any 7 specific lot minimum standards, however does include an established Regulating Plan and Map to 8 guide future development on the subject property. 9 When exercising the “quasi-judicial” authority on subdivision requests,the role of the City is to 10 determine the facts associated with a particular proposaland apply those facts to the legal standards 11 contained in the ordinance and relevant state law. In general, if the facts indicate the application 12 meets the relevant legal standards and will not compromise the public health, safety,and general 13 welfare, then the applicant is likely entitled to the approval. The City is, however, able to add 14 conditions to a subdivision approval to ensure that potentialimpacts to parks, schools, roads, storm 15 sewers, and other public infrastructure on and around the subject property are adequately addressed. 16 Subdivisions may also be modified to promote the public health, safety, and general welfare, as well 17 as to provide for the orderly, economic, and safe development of land. Finally, conditions to a 18 subdivision can be usedto promote housing affordability for all levels. 19 P LANNING C OMMISSION A CTION 20 On February 2, 2022, the Roseville Planning Commission held the duly noticed public hearing th 21 regarding the requested preliminary plat of Twin Lakes 4Addition (RPCA providedas Attachment 22 A). At the hearing one member of the public provided testimonyto the Planning Commission 23 regarding traffic concerns. The applicant’s representativewas also in attendance and addressed the 24 Commission (meeting minutes provided in Attachment B). 25 Regarding Commissioner inquiries, CommissionerSchaffhausen asked about the pathway system 26 and whether the original plan looked at a connection to Oasis Park. City Planner Paschke indicated 27 the Minor Plat review was not completed by the Planning Commission and did not originally look at 28 a pathway system. Such a review was completed with the EAW and during the Planning Divisions 29 review of the overall redevelopment project. 30 Commissioner McGehee asked whether it was possible to work with the applicant on installing a 31 pathway connection on the east side of the development,connecting the trail south of The Harbor to 32 theCounty Road C pathway.
