REQUEST FOR COUNCIL ACTION <br />Date:February 28, 2022 <br />Item No.: 10.e <br />Department ApprovalCity Manager Approval <br />th <br />Item Description:Adopt aResolution approving the Preliminary Plat of Twin Lakes 4Addition <br />(PF21-020) <br />1 B ACKGROUND <br />2 The applicant proposes to subdivide the existing outlot into five lots to facilitate commercial <br />3 development. The existing parcel, legally described as Outlot A, Twin Lakes Third Addition, was <br />4 created through a Minor Plat as a component of the Dominium residential development of The Oasis <br />5 and The Harbor. The goal at that time was to reserve a portion of the site for future commercial <br />6 development. The property is zoned Community Mixed Use (MU-2B), which does not have any <br />7 specific lot minimum standards, however does include an established Regulating Plan and Map to <br />8 guide future development on the subject property. <br />9 When exercising the “quasi-judicial” authority on subdivision requests,the role of the City is to <br />10 determine the facts associated with a particular proposaland apply those facts to the legal standards <br />11 contained in the ordinance and relevant state law. In general, if the facts indicate the application <br />12 meets the relevant legal standards and will not compromise the public health, safety,and general <br />13 welfare, then the applicant is likely entitled to the approval. The City is, however, able to add <br />14 conditions to a subdivision approval to ensure that potentialimpacts to parks, schools, roads, storm <br />15 sewers, and other public infrastructure on and around the subject property are adequately addressed. <br />16 Subdivisions may also be modified to promote the public health, safety, and general welfare, as well <br />17 as to provide for the orderly, economic, and safe development of land. Finally, conditions to a <br />18 subdivision can be usedto promote housing affordability for all levels. <br />19 P LANNING C OMMISSION A CTION <br />20 On February 2, 2022, the Roseville Planning Commission held the duly noticed public hearing <br />th <br />21 regarding the requested preliminary plat of Twin Lakes 4Addition (RPCA providedas Attachment <br />22 A). At the hearing one member of the public provided testimonyto the Planning Commission <br />23 regarding traffic concerns. The applicant’s representativewas also in attendance and addressed the <br />24 Commission (meeting minutes provided in Attachment B). <br />25 Regarding Commissioner inquiries, CommissionerSchaffhausen asked about the pathway system <br />26 and whether the original plan looked at a connection to Oasis Park. City Planner Paschke indicated <br />27 the Minor Plat review was not completed by the Planning Commission and did not originally look at <br />28 a pathway system. Such a review was completed with the EAW and during the Planning Divisions <br />29 review of the overall redevelopment project. <br />30 Commissioner McGehee asked whether it was possible to work with the applicant on installing a <br />31 pathway connection on the east side of the development,connecting the trail south of The Harbor to <br />32 theCounty Road C pathway.
