The existing parcel, legally described as OutlotA, Twin Lakes Third Addition, was <br />14 created through a Minor Plat as a component of the Dominium residential developmentof The Oasis <br />15 and The Harbor. The goalat that timewas to reserve a portion of the site for future commercial <br />16 development. The propertyis zoned Community Mixed Use(MU-2B), which does not have any <br />17 specific lot minimum standards, however does include an established Regulating Plan and Map to <br />18 guide future development on the subject property. The preliminary plat and other plans regarding the <br />19 proposed development are included with this RPCA in Attachment C. <br />20 When exercising the “quasi-judicial” authority on subdivision requests,the role of the City is to <br />21 determine the facts associated with a particular proposaland apply those facts to the legal standards <br />22 contained in the ordinance and relevant state law. In general, if the facts indicate the application meets <br />23 the relevant legal standards and will not compromise the public health, safety,and general welfare, <br />24 then the applicant is likely entitled to the approval. The City is, however, able to add conditions to a <br />25 subdivision approval to ensure that potentialimpacts to parks, schools, roads, storm sewers, and other <br />26 public infrastructure on and around the subject property are adequately addressed. Subdivisions may <br />27 also be modified to promote the public health, safety, and general welfare, as well as to provide for the <br />28 orderly, economic, and safe development of land.
