Attachment A <br />112 R EVIEW OF S PECIFIC C ONDITIONAL U SE C RITERIA: §1009.02.D.12 of the Zoning Code establishes <br />113 additional standards and criteria that are specific to drive-through facilities: <br />114 a. Drive-through lanes and service windows shall be located to the side or rear of buildings <br />115 and shall not be located between the principal structure and a public street except when the <br />116 parcel and/or structure lies adjacent to more than one public street and the placement is <br />117 approved by the Community Development Department (Ord. 1443, 6-17-2013).The basis <br />118 for this criterion is to limit vehicular impacts on adjacent roadways and the pedestrian realm. <br />119 The proposed bank has the service/teller window on the east side of the building and not in <br />120 the front of, or between, the building and public street. This orientation is acceptable to the <br />121 Community Development Departmentandwillfunction well on the site and within the <br />122 overall redevelopment area. <br />123 b. Points of vehicular ingress and egress shall be located at least 60 feet from the street right- <br />124 of-way lines of the nearest intersection.The nearest access to the Twin Lakes Station <br />125 development and the Bank of America site is the westerly right-in access, which lies <br />126 approximately 220 feet away from the nearest intersection, complying with this criteria. <br />127 Twin Lakes Station’s main signalized intersection lies more than 640 feet away from the <br />128 access into the Bank of America site. <br />129 c. The applicant shall submit a circulation plan that demonstrates that the use will not interfere <br />130 with or reduce the safety of pedestrian and bicyclist movements. Site design shall <br />131 accommodate a logical and safe vehicle and pedestrian circulation pattern. Queuing lane <br />132 space shall be provided, sufficient to accommodate demand, without interfering with primary <br />133 driving, entrance, exit, pedestrian walkways, or parking facilities on site. The circulation <br />134 plan shall be made a condition of approval and shall survive any and all users of the drive- <br />135 through and may need to be amended from time to time to ensure continued compliance with <br />136 this condition. Said amendments to the circulation plan will require an amendment to the <br />137 conditional use. The vehicular circulation plan submitted incorporates all of the commercial <br />138 development site and includes the existing walkways adjacent to The Oasis and The Harbor <br />139 multi-family residential developments (Attachment E). Specific to the Bank of America site, <br />140 a sidewalk will be extended from the pathway along the north side of County Road C to the <br />141 proposed bank building entrance on the north, which sidewalk travels around the west side of <br />142 the building adjacent to the access road. Eventually, a sidewalk will connect to the adjacent <br />143 lot in the corner of the site and its building, which sidewalk will connect to the path adjacent <br />144 to County Road C and the path along private road. Thus, proposed vehicle and pedestrian <br />145 circulation is appropriate given the demands of the site. <br />146 d. Speaker box sounds from the drive-through lane shall not be loud enough to constitute a <br />147 nuisance on an abutting residentially zoned property or property in residential use. <br />148 Notwithstanding this requirement, such speaker boxes shall not be located less than 100 feet <br />149 from an existing residentially zoned property or property in residential use. The proposed <br />150 drive-through teller canopy area lies approximately 280 feet from The Oasis apartment <br />151 building located to the north. Although there will be speakers and microphones for <br />152 communicating with a teller, said sound fromthe speakers and customers should not be loud <br />153 enough to create a nuisance for the residents of The Oasis given the 280 feet of distance and <br />154 traffic noise from County Road C. <br />PF21-020_RPCA_BOA_CU_020222 <br />Page 4 of 5 <br /> <br />
