As with the site planning and storm water management components, discussed <br />46 above, the applicant has been working with the City Planner and consulting forester to ensure that tree <br />47 preservation requirements have been properly administered as the construction phases have progressed. <br />48 More specifically, in 2018 when Phase 1 of the Edison project was approved (via the building permit <br />49 process) the Planning Division approved the initial tree preservation and restoration plan. This plan was <br />50 predicated on three phases of development and was approved with a majority of the trees being <br />51 removed, mostly to address environmental remediation of contaminated soils. That said, because of the <br />52 phased nature of the development the approved plan is fluid and could include additional tree loss <br />53 depending on how the third, and final phase of the Edison is to be developed. The Planning Division <br />54 also approved a landscape plan, which included maximum tree planting in all non-open space areas of <br />55 the project site. This plan will likely need to be modified based upon the final phase. In summary, tree <br />56 loss will exceed tree planting ability and the applicant will be required to pay the City a tree fee for the <br />57 amount of caliper inches unable to be planted. The final payment determination will be a component of <br />58 the final phase of development and be due to the City before the building permit is issued. <br />59 Park Dedication <br />60 The Parks and Recreation Commission (PRC) reviewed the proposal at its May 3, 2022, meeting and <br />61 recommended a dedication of cash in lieu of park land. Based on the 2022 park dedication fee of $4,250 <br />62 per residential unit, the applicant will be required to pay a total of $505,750 for the 119 units in phases 1 <br />63 and 2 to satisfy the park dedication requirement. If Outlot A is platted in the future for the planned third <br />64 phase, a cash dedication will be calculated at that time based on the number of proposed units and the <br />65 per-unit rate in effect at that time. An excerpt of the draft May 3 PRC minutes is included with this RCA <br />66 as part of Attachment D. <br />67 Public Comment <br />68 The duly noticed public hearing for the Minor Plat proposal will be held by the City Council on May 23, <br />69 2022. At the time this RCA was drafted, Planning Division staff have not received any comments from <br />70 members of the public regarding this proposal. <br />71 P OLICY O BJECTIVE <br />72 Ensure all sudbivisions of land lying within the incorporated limits of the City fully comply with the <br />73 regulations set forth in the Subdivision Code. Regulations and requirements for the subdivision of land <br />74 are necessary to preserve the health, safety, general welfare, convenience, and good order of the <br />75 community. <br />76 B UDGET I MPLICATIONS <br />77 Acquisition of park dedication funds. Refer to DRC comments in Attachment D. <br />78 S TAFF R ECOMMENDATION <br />79 Hold a public hearing, then adopt a resolution approving the proposed Edison Addition plat based <br />80 on the content of this RCA, public input, and City Council deliberation, with the following conditions. <br />81 1. Pursuant to the memo from Parks and Recreation staff in Attachment D of this RCA, the applicant <br />82 shall submit payment of $505,750 to satisfy the park dedication requirement pertaining to Edison 1 <br />83 and Edison 2 before the City will release the approved plat for recording at Ramsey County. <br />84 2.
