The proposal is in harmony with these purposes of the zoning and subdivision ordinances <br />93 because the new boundary between Lot 1 and Lot 2 would be straight and orthogonal to the Wheaton <br />94 Avenue right-of-way while providing a building pad for a new home on Lot 1 that is no different than if <br />95 Lot 2 was made to conform technically to the minimum required lot width at the front setback line and <br />96 narrowed to enable the existing garage on Lot 2 to meet the minimum setback from its new rear <br />97 boundary. <br />98 3. An unusual hardship on the land exists.Requiring theexisting garage on Lot 2 to be removed to <br />99 enable Lot 1 to meet the 85-foot minimum width requirement and have a straight eastern boundary will <br />100 increase the cost of the naturally occurring affordable home at 2687 Dale Street. This obstacle to <br />101 designing Lot 1 to achieve the minimum width standard while using a straight boundary and preserving <br />102 the affordability of the existing house at 2687 Dale Street constitutes an unusual hardship, which the <br />103 subdivision variance process is intended to relieve. <br />104 4. The variance, if granted, will not alter the essential character of the locality. If the requested <br />105 subdivision variance is approved, the approval will not alter the essential character of the locality <br />106 because a new home would be built within essentially the same footprint as proposed whether the <br />107 requested subdivision variance is approved or not. <br />108 Public Comment <br />109 The City Council is responsible for holding a public hearing, which becomes an essential part of the <br />110 public record, prior to taking action on the subdivision application.
