<br />82 Proposed Chapter 804: Wetlands - All upland within 100 feet of the delineated <br />83 boundary of a wetland, and includes a maximum impervious coverage of 25%. <br />84 A proposed addition to the Chapter is the inclusion of wetland buffer width <br />85 averaging. With the proposedbuffer averaging rule, a buffer must be on <br />86 average 25 feet wide, but can be as narrow as 12.5 feet wide. This buffer <br />87 averaging language is consistent with the local watershed district rules, who are <br />88 the Local Government Units (LGUs) in charge of administering the Wetland <br />89 Conservation Act (WCA) rules. <br />90 Chapter 803.04: Grading, Erosion and Sedimentation Control; language was <br />91 modified to include only the first ring properties (or up to 300 feet, whichever <br />92 is greater) for water resources identified in our Shoreland Ordinance, instead <br />93 of increasing the distance to 1,000 feet. The 300-foot distance from a water <br />94 resource identified in this chapter is consistent with our current permitting <br />95 rules. Increasing the distance to 1,000 feet from a water resource identified in <br />96 our Shoreland Ordinance Chapter would affect 2,557 properties, and would <br />97 require these properties to apply for a Grading, Erosion and Sedimentation <br />98 Control permit when doing any modification to their property. <br />99 o Include references to Title 8 within the Shoreland Overlay where appropriate <br />100 o Definitions –staff reviewed the definitions in the Shoreland Overaly and Section 1001 <br />101 to make sure there are not duplicates or conflicts <br />102 Electric vehicle charging standards (Section 1019.04): <br />103 o Clean up the references to EVCS and EVSE <br />104 o Revise Table 1019-2 regarding accessible parking space requirements <br />105 o Make sure fractional numbers require rounding up to one <br />106 New & revised definitions (Section 1001.10): <br />107 o No additional comments beyound ensuring there are not duplicates and/or conflicts <br />108 between the definitions in the Shoreland Overlay and Section 1001 <br />109 Revised landscaping standards (Section 1011.03): <br />110 o No changes needed <br />111 Creation of sustainability incentives (new Section 1011.13): <br />112 o Remove entirely – concern about the stacking of incentives, reconsider at a different <br />113 time, maybe as a pilot project <br />114 <br />115 The Ordinances provided in Attachments A and B incorporate the City Council direction received at <br />th <br />116 the January 30 meeting. <br />117 <br />118 The Public Works Environment & Transportation Commission reviewed the changes to Title 8 at their <br />119 February 28, 2023 meeting and recommended acceptance of the proposed ordinance changes. <br />120 <br />121 Representatives from HKGi are not available to attend the meeting. City staff should be able to address <br />122 any questions or concerns, but given HKGi has most of the Shoreland Overlay and electric vehicle <br />123 requirement expertise, it is possible questions could arise that staff cannot answer. If that occurs, the <br />124 item should be tabled to a future meeting to ensure HKGi is available. <br />125 <br />126 Given the length of the ordinances provided in Attachments A and B, a summary publication is <br />127 recommeded to save on publishing costs.
