RCA Attachment A <br />510 the adjoining setbacks from the OHWL, provided the proposed structure is not located in <br />511 a shore impact zone or in a bluff impact zone (see Figure 1012-6); <br />512 Figure 1012-6: Structure Setback Averaging <br />513 v. Setbacks of decks: Deck additions may be allowed without a variance to a structure not <br />514 meeting the required setback from the ordinary high water level if all of the following <br />515 criteria are met. <br />516 A. The structure existed on the date the structure setbacks were established; <br />517 B. A thorough evaluation of the property and structure reveals no reasonable location for <br />518 a deck meeting or exceeding the existing ordinary high water level setback of the <br />519 structure; <br />520 C. The deck encroachment toward the ordinary high water level does not exceed 15 <br />521 percent of the existing setback of the structure from the ordinary high water level or <br />522 is no closer than 30 feet from the OHWL, whichever is more restrictive; and <br />523 D. The deck is constructed primarily of wood or composite materials having the <br />524 appearance of wood, and is not roofed or screened (see Figure 1012-7). <br />Page 18 of 32 <br /> <br />
