i. The lot must meet the area and width requirements for residential lots, and be suitable for 478 <br />the intended uses of controlled access lots as provided in subsection iv below; 479 <br />ii. If docking, mooring, or over-water storage of more than six (6) watercraft is to be 480 <br />allowed at a controlled access lot, then the width of the lot (keeping the same lot depth) 481 <br />must be increased by a percentage of the requirements for riparian residential lots for 482 <br />each watercraft beyond six, consistent with the following table: 483 <br />Ratio of lake size to <br />shore length (acres/mile) <br />Required percent <br />increase in frontage <br />Less than 100 25% <br />100 – 200 20% <br />201 – 300 15% <br />301 – 400 10% <br />Greater than 400 5% <br />iii. The lot must be jointly owned by all purchasers of lots in the subdivision or by all 484 <br />purchasers of non-riparian lots in the subdivision who are provided riparian access rights 485 <br />on the access lot; and 486 <br />iv. Covenants or other equally effective legal instruments must be developed that: 487 <br />A. Specify which lot owners have authority to use the access lot; 488 <br />B. Identify what activities are allowed. The activities may include watercraft launching, 489 <br />loading, storage, beaching, mooring, docking, swimming, sunbathing, or picnicking; 490 <br />C. Limit the total number of vehicles allowed to be parked and the total number of 491 <br />watercraft allowed to be continuously moored, docked, or stored over water; 492 <br />D. Require centralization of all common facilities and activities in the most suitable 493 <br />locations on the lot to minimize topographic and vegetation alterations; and 494 <br />E. Require all parking areas, storage buildings, and other facilities to be screened by 495 <br />vegetation or topography as much as practical from view from the public water, 496 <br />assuming summer, leaf-on conditions. 497 <br />5. Placement, Height, and Design of Structures 498 <br />a. OHWL Setback for Structures. When more than one setback applies to a site, structures and 499 <br />facilities must be located to meet all setbacks, and comply with the following OHWL setback 500 <br />provisions. 501 <br />i. General Development Lake – 50 feet 502 <br />ii. Natural Environment Lake – 150 feet 503 <br />iii. OHWL Setbacks. Structures and impervious surfaces must meet setbacks from the 504 <br />Ordinary High Water Level (OHWL), except that one water-oriented accessory structure 505 <br />or facility, designed in accordance with Section 1012.03.G.3 of this ordinance, may be set 506 <br />back a minimum distance of ten (10) feet from the OHWL. 507 <br />iv. Setback averaging. Where structures exist on the adjoining lots on both sides of a 508 <br />proposed building site, structure setbacks may be altered without a variance to conform to 509 <br />RCA Attachment A <br />Page 17 of 32
