the adjoining setbacks from the OHWL, provided the proposed structure is not located in 510 <br />a shore impact zone or in a bluff impact zone (see Figure 1012-6); 511 <br />Figure 1012-6: Structure Setback Averaging 512 <br />v. Setbacks of decks: Deck additions may be allowed without a variance to a structure not 513 <br />meeting the required setback from the ordinary high water level if all of the following 514 <br />criteria are met. 515 <br />A. The structure existed on the date the structure setbacks were established; 516 <br />B. A thorough evaluation of the property and structure reveals no reasonable location for 517 <br />a deck meeting or exceeding the existing ordinary high water level setback of the 518 <br />structure; 519 <br />C. The deck encroachment toward the ordinary high water level does not exceed 15 520 <br />percent of the existing setback of the structure from the ordinary high water level or 521 <br />is no closer than 30 feet from the OHWL, whichever is more restrictive; and 522 <br />D.
