Regular City Council Meeting <br /> Monday,November 6, 2023 <br /> Page 2 <br /> Mr. Trudgeon explained staff has let the new license holder know that this <br /> suspension would have to be served under their license and staff did speak at length <br /> with the City Attorney to make sure this was appropriate for the City to do and was <br /> told it was. <br /> Mayor Roe asked if there was anything in the documentation that the City is doing <br /> with the transferee as to knowing that the suspension is a part of the scenario. <br /> Mr. Trudgeon thought it would be included in the letter sent to the applicant. <br /> Mayor Roe reviewed public hearing protocol and opened and closed the public <br /> hearing at approximately 6:41 p.m. for the purpose of receiving public input on the <br /> above-referenced transfer of liquor license; with no one coming forward. <br /> Etten moved, Strahan seconded, approval of an On-Sale Wine and 3.2% Liquor <br /> License for ZL Eats, LLC dba Szechuan's, Pending Submittal of any Outstanding <br /> Items, and Ordering the 5 Day Suspension Once the License is Issued. <br /> Roll Call <br /> Ayes: Strahan, Etten, Schroeder, Groff, and Roe. <br /> Nays: None. <br /> b. Consider an Abatement Request for Unresolved City Code Violations at 167 <br /> Wewers Road <br /> City Manager Trudgeon asked to remove this item from the agenda because the <br /> junk/debris is being cleaned up which resolves the violation. <br /> c. Public Improvement Hearing for County Road B Reconstruction Project <br /> Assistant Public Works Director Jennifer Lowry briefly highlighted this item as <br /> detailed in the Request for Council Action and related attachments dated November <br /> 6, 2023. <br /> Mayor Roe asked for clarification on the amount of the project being assessed,why <br /> the project is unable to be one hundred percent funded with MSA funds or the City's <br /> own street fund, what gap is left, and why is there a gap. <br /> Ms. Lowry explained it is applying the City's special benefit policy that calls for <br /> the City to assess for these improvements. There are different assessments such as <br /> if residents are requesting certain improvements versus the City bringing a project <br /> forward. There are benefits that would be seen to these individual properties and <br /> the policy asks that those properties pay a portion of the project costs because they <br /> will see a benefit to their properties, for example, when they sell. <br /> Mayor Roe wanted to make sure the assessment was not for a design element that <br /> would be above and beyond an amount where it would need to be assessed. <br />
