Knowledge <br />of Occurrence�• K of the agent <br />ence yconstitute, <br />�shall nnot cinr <br />servant or employee oftheinsured itself <br />knowledge by the insured unless an executive officer of the <br />insured or a partner of the insured, or the insured himself, if he <br />is a sole proprietor, shall have received such notice from its <br />agent, se -,!ant or employee. <br />Notice <br />e. of Occurrence: there the insured reports any occurrence to <br />the compensation carrier insuring its compensation insurance which <br />later develops into a liability claim, coverage for which is <br />provided by the policy to which this endorsement is attached, <br />failure to report such occurrence to the insurer at the time of <br />the occurrence shall not be deemed in violation of policy <br />conditions relating to notice to the insurer upon the distinct <br />understanding and agreement, however, that the insured just as <br />soon as it is definitely made aware of the fact that the <br />particular occurrence is a liability case rather than a <br />compensation case, shall give notification of the aforesaid <br />occurrence to the Insurer. <br />f. Incidental Malpractice liability - It is agreed that such <br />Insurance as is afforded by the policy for bodily injury and <br />property damage liability, applies subject to the Following <br />provisions: <br />1. The insurance also applies to injury, sickness, disease, death <br />or destruction occurring during the policy period and arising <br />out of malpractice, error or mistake committed at or in <br />connection with the premises: <br />a. in the rendering of or failure to render medical, <br />surgical, dental, X-ray or nursing service or treatment, <br />or the furnishing of food or beverages in connection <br />therewith, or <br />b. the furnishing or dispensing of drugs or medical, dental <br />or surgical supplies or appliances. <br />2. The insured 1 u shall give written notice in accordance with the <br />notice of occurrence and notice of claim or suit conditions of <br />the policy, upon becoming aware of any claim or allegation of <br />malpractice, error or mistake. <br />3. The limit of liability stated in the declaration as applicable <br />to each occurrence shall also be the total limit of the <br />Insurer's liability under this endorsement. <br />SECTION 00800 - b <br />
