VII - D <br />' <br />C. Damages: In general, it is the intent of this <br />paragraph that upon condemnation, the parties hereto <br />shall share in their award to the extent that their <br />interests, respectively, are depreciated, damaged or <br />destroyed by the exercise of the rights of eminent <br />domain and that Tenant shall have the right to par- <br />ticipate in any award for such public taking to the <br />extent that it may have suffered compensable damage as`a <br />Tenant on account of such public taking. The parties <br />agree that should there be a dispute regarding; the <br />respective shares of a condemnation award that the par- <br />ties will submit the dispute to the American Arbitration <br />Association for binding arbitration pursuant to the <br />rules of said association. <br />17• Default by Tenant. <br />Notice and Termination, Landlord's Options: <br />In the event that: <br />(1) Tenant shall default in the payment of any sum <br />of money required to be paid hereunder and such <br />default continues for thirty (30) days after <br />written notice thereof from Landlord to Tenant; <br />or <br />(2) Tenant shall default in the performance of any <br />other provision, covenant or condition of this <br />-16- <br />VII - D <br />
