0 <br />NCSCO—ELF (GP-00_•—MIS) <br />This general permit authorizes the above activities provided the activity <br />is regulated and approved under appropriate state laws and rules. <br />h. Fish_ Barriers — Structures or clean fills used to impede the movements <br />of rough fish for fisheries management purposes. The barrier must not <br />significantly impede the flow of water and must be regulated and approved <br />under appropriate state laws and rules. <br />i. Cofferdams and Caissons — Temporary structures or fills used to de — <br />water construction sites. The cofferdam or caisson must be removed in its <br />entirety at the earliest possible date. The cofferdam or caisson must be <br />regulated and approved under appropriate state laws and rules, including <br />those by the Minnesota Pollution Control Agency (MPCA). <br />j. DredRinsi — The removal by suction, scooping or scraping devices, of <br />materials below the ordinary high—water mark of navigable waters of the <br />United States. For this general permit to apply, the following special <br />conditions must be met (also see special condition q on page 3A: <br />1. All dredged material must be placed in an upland location. <br />Z. Total dredged amounts must not exceed 3,000 cubic yards. <br />Piecemealing of projects is not permitted. <br />3. Dredging must not occur in an area of concentrated shellfish <br />production or in a designated spawning area. <br />4. If hydraulic dredging methods are used, approval must be obtained <br />from the Minnesota Pollution Control Agency for the return flow. <br />5. The dredging must be regulated and approved under appropriate state <br />laws and rules. <br />k. Channel Connections — The connection, of any waterbody (natural or man— <br />made) to a navigable water of the United States for private recreational <br />access from riparian properties only, provided the connection would not <br />result in the drainage or filling of any wetland area. The connection must <br />be regulated and approved under appropriate state laws and rules. <br />1. Wing Dams and Deflectors — Structures or fills designed to divert the <br />flow of a stream to maintain a stream channel with desired depth, or reduce <br />erosion and/or sedimentation. The structure or fill must not present a. <br />hazard to commercial and recreational navigation. Water must flow over the <br />top of the structure or fill at above normal water levels. The structure <br />or fell must be regulated and approved under appropriate state laws and <br />rules. <br />
