e <br />Is <br />CASE NUMBER: 1.569-84 <br />Page 5 <br />continued access from the extension of American Street to County <br />Road B-2 and the extension of access to the bank site. <br />The City is negotiating with the owners of the Audio King building <br />for right-of-way for the extension of American Street to the <br />southwest into the subject property. Mr. Drown informs us that the <br />condition for this access will be that the developer pay for the <br />changes to the street configuration and parking lot. Under these <br />conditions, the owners propose to provide the easement without cost <br />to the City. A condition might be added that the developer pay for <br />these improvements, inasmuch as they are designed t,) accommodate the <br />access configuration proposed as part of the development plan. <br />Though the two st,upping center developers have agreed on a common <br />access drive along the east side of the subject property, a <br />condition should be attached requiring evidence of a written <br />agreement to perpetuate the rights to access on this north -south <br />roadway to both parties. <br />c. Grading. The ten foot landscaped strip on the property on the north <br />side of the building is indicated on the grading plan to have a 2:1 <br />P'.ope down to the Williams pipeline property. The chain link fence <br />is proposed to be built in the middle of this strip, and thus, will <br />be located on a steep side hill. This will create a "trap" on the <br />south side of the fence which we feel could be undesirable from a <br />maintenance standpoint. Thus, we have asked the architects to <br />prepare a more detailed examination of this condition to hopefully <br />achieve a more workable solution. Perhaps a retaining wall along <br />portions of this site would be an appropriate solution. <br />The grading plan also indicates a five percent slope for the two <br />driveway access points south of the shopping center to Fairview <br />Avenue. The engineers point out that there should be a level spot of <br />at least 50 feet in length directly east of the exits to Fairview <br />Avenue at these points. The current plan shows the five percent <br />slope going directly to the right-of-way line. There is also a <br />portion of the property contiguous to Fairview Avenue (in the ten <br />foot planting strip between the parking and the right-of-way) which <br />appea.g to have a 2:1 slope. This will be difficult to maintain and <br />could be a problem for pedestrians walking on the sidewalk which will <br />be constructed just inside the right-of-way on Fairview Avenue. <br />You will notice a substantial grading project in the form of a <br />holding pond in the northwest corner of the site. The City has <br />successfully negotiated with the Williams pipeline people and the <br />neighbors and propose to construct a ponding area utilizing the <br />existing street right-of-way and lots that the City owns fronting on <br />Oakcrest. The pipelines through this ponding area have already been <br />lowered at the request of the City. Financing of the construction of <br />this pond is one of the substantial ingredients of the tax increment <br />district benefits. Mr. Drown can elaborate in more detail regarding <br />this improvement project and others which are a part of the total <br />project development. <br />
