Other financial aid requested is the waiving of the $5,000 legal fee of the <br />city attorneys in the condemnation offer and settlement activities. Although <br />originally discussed with the developers as a <br />it is now the staffs it aid to the development, <br />position that the city not participate in this expense. <br />Tho developer had requested the c1ty to provide significant additional <br />financial assistance. This was in the form of removing or relocating all the <br />structures that exist on the site. This $90,000 would have increased the city <br />assistance to $568,000. <br />The developer was informed that if the city did become involved in the housing <br />relocation, or potentially other such items of assistance, that a developers <br />agreement would be required. TANURB now concludes that they do not want a <br />development agreement and withdrew their request on the homes. <br />The council thus has several difficult decisions to make concerning this <br />development. If there i:a confidence that the remaining items will be available <br />in tiro for staff review and comment before the requested January 2, 1985 <br />Planning Commission hearing, then the referral could be made. This, of course, <br />also assumes at resolution on the level and fora of city funding assistance <br />being resolved prior to the hearing date. If not, the matter should be <br />continued to the Janujjry 14, 1985 council tooting.
