HEAD APPROVAL. <br />Reports and Recommendations Administration AL-,L <br />ITEM NO.: ITEM DESCRIPTION' Tanurb Developments, Inc. request for MG EVIEWED/RECOMMENDS: <br />rezoning, special use permit, vacation of right-of-way <br />and vnri nncPs at 24RO i'nirview Avenue. <br />The Planning Commission, at its January 2 meeting, unanimously recommended approval <br />of Tanurb Developments, Inc. request for rezoning from R-1 to Shopping Center, special <br />use permit for site plan approval, variances to building setback to allow the building <br />to be set back 50 feet on the north, 17 feet on the west, and 10 feet on tlae east, <br />and vacation of right-of-way at 2480 Fairview Avenue, with the following conditions: <br />1) That the cost of the roadway changes on American Street be paid for by the <br />developer. <br />2) That right-of-way be dedicated on Fairview Avenue to provide for 49.5 feet of <br />right-of-way. <br />3) That the following easement documents be recorded: <br />a. Access easements for use of the Mid -America Bank's private drive on County <br />Road B-2. The City reserves the right to close the access to B-2 via the <br />Mid -America Bank entrance if, in the opinion of the City, a traffic problem <br />exists, <br />b. Casement for the use of the common drive between the proposed development <br />and the development to the east. <br />c. Access easement to sallow public use of the private roadway from the west and <br />of American Street to a public street. <br />d. Ponding easement for construction and maintenance of the stormwater pond in <br />the northeast corner of the site. <br />e. Easement for planting; and maintaining landscaping on the Williams Brothers <br />Pipeline Company property. <br />f. Utility easements for existing utilities remaining after the right-of-way <br />vacation, and for other necessary utility services. <br />4) That the City be responsible for maintenance of the stormwater pond. <br />S) That the utilities, grading, parking, landscaping, and rooftop screening plans <br />be subject to staff approva 1. <br />G) 'lliat the exterior material be bxick on all four sides of tlae building. <br />7) Tliat approval of the proposed rest,iurant be subject to staff review. <br />8) That there be no less than 819 parking spaces. <br />9) That the vacaation of the streets be subject to a re -plat of the property. <br />10) That the project be developed :according to plans dated December 7, 1984. <br />As the applicant had requested the public hearing before the Council be delayed <br />until February, the Council may now sot the public hearing for the February 11, 1985 <br />Council meeting. <br />COUNCIL ACTION REQUESTED: Motion establishing; the public tac.firing on the Tanurb <br />Developments, Inc. application for the February 11, 1985 <br />Council mootin. <br />
