Prior to starting any such filling or relocation, Welsh shall obtain for the benefit and use of Equitable and the Equitable Parcel perpetual, non-exclusive rights, privileges, easements and approvals from all necessary persons and governmental bodies, including, but not limited to, the applicable watershed district, Roseville and Ramsey County, to use the new, relocated retention pond. The retention pond and all associated storm sewer lines, pipes and surface water which are currently located on or drain into the Equitable Parcel will be re-routed to the new relocated retention pond by Welsh without cost to Equitable.
