Draft as of 1/18/90 <br />CITY OF ROSEVILLE <br />DEVELOPMENT CONTRACT <br />This Agreement is made and entered into on the __ day of <br />, 199_, by and among the City of Roseville, a <br />mi1i►.i cipal.ity of the State of Minnesota ( the ,city,,); and Welsh. <br />Ci-ossrc)ads 89, a Minnesota general partnership (the "Developer") <br />(collectively the "Parties"). <br />WHEREAS, the Developer owns certain real property legally <br />described on Exhibit A hereto and the improvements located thereon <br />which include a retail shopping center and parking facilities and <br />which are commonly referred to as "Pavilion Place" (collectively <br />the "Pavilion Place Parcel"); and <br />WHEREAS, the Developer owns certain real property adjacent to <br />the Pavilion place Parcel legally described on Exhibit B hereto <br />(the "Crossroad-z Parcel"); and <br />WHEREAS, the Developer intends to construct an addition to <br />flay.i.l.i on Place, to be called "Crossroads of Roseville" on the <br />l'i-ossroads Parcel; and <br />WHEREAS, the Pavilion Place Parcel and the --.:ossroads Parcel <br />i )(104the,- with any improvements constructed or to be constructed <br />11it',reon and any easements appurtenant thereto, shall be referred to <br />(—Llect ively as the "Project". <br />WHEREAS, the Developer has requested that the City: <br />1. Amend its Comprehensive Plan to allow for the rezoning of <br />tale Crossroads Parcel from a R-1 zoning classification to a SC <br />zoning classification. <br />2 Amend the City's official Zoning Map to rezone the <br />Crossroads Parcel from a R-1 zoning classification to a SC zoning <br />classification; pursuant to the provisions of Chapter 16 of the <br />City Code of Roseville (tile "City Code") . <br />3. <br />Approve the <br />Planned <br />Unit Development ("PUD") that the <br />Developer <br />has proposed <br />for. the <br />Croq.iroads Parcel pursuant to the <br />pl.-t-iv.isions <br />of Chapter 17 <br />of the <br />City Code. <br />4. Gi:ant the Developer a variance from the requirements of <br />1;cortioil of the City Code pursuant to the provisions of Chapter <br />I of the City Code which variance shall allow Developer to <br />5. Approve the preliminary and final Plat of Welsh Crossroads <br />f10, pursuant to the provisions of Chapter 20 of the City Code. <br />
