6. Issue a Building Permit to the Developer pursuant to the provisions of Chapter 31 of the Crossroadsof of Ro �veflle thonlZthe ing the Developer to construct Crossroads Parcel. 7. Construct the City Improvements herein defined. g. Vacate the city's right-of-way easement on, over and across American Street. 9. Grant the Developer an Easement, for parking purposes on, over and across the property legally described on Exhibit D hereto (Lhe "Parking Easement Parcel"). 10. Issue a Certificate of Occ,oancy to the Developer upon the completion of Crossroads of Roseville. WHEREAS, in anticipation of and consideration agreement, the city has theyeady recitalkesetthforthtions above following paragraphs and above; / WHEREAS, the City will take the actions set forth in following paragraphs of the recitals set forth above 1 ' and above provided that, the Developer enters into this Development Contract and performs all of the obligations that this n(-�velopment Contract and the City Code impose upon the Developer. NOW THEREFORE, in consideration of the premises snts set offorth above and the representations, warranties and he i)arties set forth in this Agreement, the City and the Developer agree as follows: ARTICLE I DEFINITIONS of this forth in 1.1 "Agreement" means this Development Contract. 1.2 "City" means the City of Roseville, a 14innesota municipal corporation except as otherwise defined in and for the purposes of Article 12 hereof. 1.3 "City Code" means the City code of the City of Roseville. 1.4 "City Emergency Access Improvements" endescribed on and the lattached jointly and severally, the improvements C:xhibit L, of this Development Contract. 1,5 "City Improvements" means and includes, jointly and severally, the City Roadway Improvements; the City Storm Sewer Improvements; and the City Emergency Access Improvements.
