However, if the site were still a service <br />station, City regulations would allow a five foot setback in <br />that case. <br />Under these conditions, an additional five feet of <br />right-of-way is required for County Road D. Mr. Fearing <br />proposed to dedicate that ten feet as a part of this <br />development improvement. <br />One of the problems with the site as reconstructed will be <br />the location for his sign. Because the site is so small it <br />will be, of course, difficult to relocate the small sign <br />thirty feet from the right-of-way as required. He is <br />therefore requesting the existing sign three feet from the <br />new property line which is ten feet back from the existing <br />property line on County Road D. Because of the very tight <br />nature of the site and the importance of retaining as much <br />workable parking as possible, it would appear that a <br />reasonable hardship condition exists here for a variance to <br />the sign location. <br />You will note too that a new fence is proposed along the west <br />property contiguous to the duplex on the west side of the <br />site. This fence will extended along the south property <br />line. <br />The request then is <br />existing structure <br />approximately four <br />setback from fifteen <br />Fairview. The sign <br />feet. <br />for a variance to the setback to the <br />from the required ten feet to <br />feet; and a variance to the parking <br />feet to five feet on County Road D and <br />variance is from thirty feet to three <br />The alternate option is to simply leave the site as it is. <br />It would appear, however, that the overall appearance and <br />function of the site will be improved by the elimination of <br />the one driveway nearest the intersection and completion of <br />the development improvements proposed. <br />The City has received a letter dated July 24 from John <br />Schiller who resides at 3104 North Fairview Avenue. A copy <br />of that letter is attached. <br />
