Final Draft <br />December 18, 2003February 12March 4, 2024 <br />Page 4 of 7 <br />131 through a petition process that includes signatures representing at least <br />60% of the property in the project area. <br />132 <br />133 Petition Process <br />134 Upon receipt of a petition signed by the owners of sixty percent <br />135 (60%) of the property area within the proposed project limits, City <br />136 staff will prepare a preliminary report detailing the streetlight <br />137 types, location, costs, and proposed assessments. <br />138 The City Council will be asked to call and hold a public hearing <br />139 pursuant to Minnesota Statutes, Section 429.031. <br />140 If the project goes to the public hearing, but is not ordered forward, <br />141 subsequent petitions will not be undertaken for the same project <br />142 area or any part of the project area for a two (2) year period <br />143 beginning on the hearing date. The exception to this requirement <br />144 would be if the City initiates a street reconstruction project in the <br />145 area. <br />146 o Funding <br />147 The additional costs of an E“Enhanced District eet lighting” project shall <br />148 be assessed to the benefiting property owners according to City <br />149 Assessment Policy. All properties within 150 feet (Street frontage) of <br />150 each light shall be considered for assessment. City staff shall determine <br />151 the number and locations of lights that could have been installed under the <br />152 “Standard StreetDistrict Light” section of this policy. The maintenance <br />153 cost for these lights will be deducted from the overall project cost. <br />154 A summary of the assessable cost shall be as follows: <br />155 Cost of installation of enhanced streetlights <br />156 plus Cost of Operation, Maintenance (pro-rated for 25 years) <br />157 plus Administrative costs <br />158 minus “Standard DistrictStreet Light” maintenance cost (if <br />159 applicable) <br />160 = total assessable cost. <br />161 Xcel energy provides a 25-year warranty for lightsthe streetlightsthat they <br />162 install. This is included in the City’s monthly charge. At the end of this <br />163 period the City will evaluate the maintenance needs for the “enhanced” <br />164 areas. A reconstruction project will be considered where the new <br />165 operation and maintenance costs for the next 25 years will be proposed to <br />166 be assessed to the benefiting properties. <br />167 IV. Standard Street Lights <br />168 In order to develop a rational approach to streetlight installation, the City Council in 1957, <br />169 established a policy to install streetlights at no assessment to ensure that the lights would <br />170 be installed where most needed and wanted. The “Standard Street Light” installation is a <br />171 continuation of this policy. <br />172 <br />173 A.
