Final Draft <br />December 18, 2003February 12March 4, 2024 <br />Page 6 of 7 <br />218 Upon receipt of a petition signed by the owners of sixty percent (60%) of the property <br />219 area within the proposed project limits, City staff will prepare a preliminary report <br />220 detailing the streetlight types, location, costs, and proposed assessments. <br />221 The City Council will be asked to call and hold a public hearing pursuant to Minnesota <br />222 Statutes, Section 429.031. <br />223 If the project goes to the public hearing, but is not ordered forward, subsequent petitions <br />224 will not be undertaken for the same project area or any part of the project area for a two <br />225 (2) year period beginning on the hearing date. The exception to this requirement would <br />226 be if the City initiates a street reconstruction project in the area. <br />227 <br />228 C.Funding <br />229 The additional costs of an “Enhanced street lighting” project shall be assessed to the <br />230 benefiting property owners according to City Assessment Policy. All properties within <br />231 150 feet (Street frontage) of each light shall be considered for assessment. City staff shall <br />232 determine the number and locations of lights that could have been installed under the <br />233 “Standard Street Light” section of this policy. The maintenance cost for these lights will <br />234 be deducted from the overall project cost. <br />235 <br />236 A summary of the assessable cost shall be as follows: <br />237 <br />238 Cost of installation of enhanced streetlights <br />239 plus Cost of Operation, Maintenance (pro-rated for 25 years) <br />240 plus Administrative costs <br />241 minus “Standard Street Light” maintenance cost(if applicable) <br />242 = total assessable cost. <br />243 <br />244 Xcel energy provides a 25 year warranty for lights that they install. This is included in the <br />245 City’s monthly charge. At the end of this period the City will evaluate the maintenance <br />246 needs for the “enhanced” areas. A reconstruction project will be considered where the new <br />247 operation and maintenance costs for the next 25 years will be proposed to be assessed to <br />248 <br />the benefiting properties. <br />249 <br />250 VI.V. Development/ Redevelopment Streetl Lights <br />251 The Developer of any proposed subdivision or redevelopment area, whether residential, <br />252 commercialbusiness or other may elect to install street lightsstreetlights as a part of their <br />253 overall development plans. Approval and implementation shall conform to this policy. <br />254 Developers shall meet the Streetlight Standard District criteriaDistrict Policy unless they <br />255 apply to meet other district criteria. Installation of public streetlights shall be included as <br />256 part of the development agreement. <br />257 <br />258 <br />259 A.
