Final Draft December 18, 2003February 12March 4, 2024 Page 6 of 7 218 Upon receipt of a petition signed by the owners of sixty percent (60%) of the property 219 area within the proposed project limits, City staff will prepare a preliminary report 220 detailing the streetlight types, location, costs, and proposed assessments. 221 The City Council will be asked to call and hold a public hearing pursuant to Minnesota 222 Statutes, Section 429.031. 223 If the project goes to the public hearing, but is not ordered forward, subsequent petitions 224 will not be undertaken for the same project area or any part of the project area for a two 225 (2) year period beginning on the hearing date. The exception to this requirement would 226 be if the City initiates a street reconstruction project in the area. 227 228 C.Funding 229 The additional costs of an “Enhanced street lighting” project shall be assessed to the 230 benefiting property owners according to City Assessment Policy. All properties within 231 150 feet (Street frontage) of each light shall be considered for assessment. City staff shall 232 determine the number and locations of lights that could have been installed under the 233 “Standard Street Light” section of this policy. The maintenance cost for these lights will 234 be deducted from the overall project cost. 235 236 A summary of the assessable cost shall be as follows: 237 238 Cost of installation of enhanced streetlights 239 plus Cost of Operation, Maintenance (pro-rated for 25 years) 240 plus Administrative costs 241 minus “Standard Street Light” maintenance cost(if applicable) 242 = total assessable cost. 243 244 Xcel energy provides a 25 year warranty for lights that they install. This is included in the 245 City’s monthly charge. At the end of this period the City will evaluate the maintenance 246 needs for the “enhanced” areas. A reconstruction project will be considered where the new 247 operation and maintenance costs for the next 25 years will be proposed to be assessed to 248 the benefiting properties. 249 250 VI.V. Development/ Redevelopment Streetl Lights 251 The Developer of any proposed subdivision or redevelopment area, whether residential, 252 commercialbusiness or other may elect to install street lightsstreetlights as a part of their 253 overall development plans. Approval and implementation shall conform to this policy. 254 Developers shall meet the Streetlight Standard District criteriaDistrict Policy unless they 255 apply to meet other district criteria.
